Debt Collector Default Notice - What to do?

Hello ppl,

I'm hoping someone can help.

I posted in the past about this debt, see here http://forums.moneysavingexpert.com/showthread.html?t=105484

I have now had a letter from the Debt Collectors saying the following -

"Dear ****

This letter and attached Default notice have been sent to you, on behalf of Littlewoods finance company trading as Littlewoods Flexible Account, because you have not paid the arrears on your account.

You must pay the arrears by 23 July 2006.

The notice is telling you that, if you do not pay the amount of £958.00 BY 23 JUL 2006, the following will happen:

If the DEFAULT NOTICE is registered (please see attached document) this information will be sent to credit reference agencies, who will record this DEFAULT on your file.

Court Procedings may be instigated against you. This means:
*More costs may be added to your account due to solicitors fees.

Our representative may call to your door.

DO YOU REALLY WANT THIS TO HAPPEN?"



As i have had a letter from Littlewoods stating that they are not pursuing the debt, can this Debt collector really do any of these things?

I cant afford to pay this debt, and dont think I have to as Littlewoods have 'written it off'...

I am really worried, as i dont want to go to court, or have someone at my door.

Please could someone advise me what to do?

    Hi,
    send them a copy of the letter from Littlewoods and state as far as you are concerned, the debt is now settled. May be worth asking your CAB to draft a copy.

    I have already done this mcbirnie25 about 1 week ago I sent them a copy of the littlewoods letter.

    I can't imagine the debt being legally enforceable though if Littlewoods have stated they aint pursuing it, and i reckon these vermin are trying it on.
    My advice would be writing to ;Littlewoods again, seeking clarification of the letter.

    hi a default id something your ceditor will have applied to your account if you miss x amount of payments some companies issue at 6 some at 8 it basically shows as a (D) on your credit details about the account is it possible that this campany has bought the debt from littlewoods if thats the case send recorded delivery a copy of the letter from l/w dont send this company any money right them a long letter asking for a copy of the original signed credit agreement and a copy of the letter of enforcement that they have from littlewoods acting on their behalf (make sence)
    then get back to us
