Maternity Leave

Evening all,

I am currently 29 weeks pregnant with my second child. I have requested that my maternity leave doesn;t start until I am 38 weeks pregnant.

I have 3 jobs, all within schools, 2 of these jobs are on contract, my main job which is 3 days a week. The 2nd contract job which is a couple of hours a month and the 3rd job which ranges from 6 to 8 hours a month this is paid on a timesheet.

Due to health issues and my boss at my main job being a complete cow, I am looking at starting my maternity leave early. However I feel responsible for my other 2 schools, both of which are lovely and supportive.

So what I am trying to say is it possible for me to start maternity leave for my main job but keep on working at my other jobs until closer to my due date?

    In short, no. Assuming you will be receiving Maternity Pay (SMP or otherwise), you cannot be paid for work carried out while on Maternity Leave, except your Keeping in Touch days, which is different to what you are wanting to do.

    The following is from page 28 of Employer helpbook for SMP E15(2009)

    "Employee has more than one employer.
    If your employee has more than one employer they can
    get SMP from each employer if they satisfy all the
    qualifying conditions. They can choose to take different
    time off from each employer."

    Your SMP will only stop if you work for the employer paying the SMP (other than KIT days) or work for another employer who you did not work for during the 15th week before the EWC.
    Have you been working for all your employers longer than this?

    "If your employee is working for someone who
    employed them in the 15th week before the week
    baby due, you should continue to pay them SMP
    as normal."
