Being Chased For A Loan

Hi folks, some advice if you can please.

I got a phone call from a company late last year asking me about a loan company in London. I had not heard of it and told them so.

I then started getting letters about a loan I am supposed to ahve taken out in 1995 when I lived in London. I know nothing about this but it does tie in with an ex-partner who got up to all sorts of financial fraud in my name.

I'm not so much worried about whether my ex took out the loan, but more about whether this company can chase me 11yrs after this loan was supposed to have been taken out?

I am vaguely aware of the Act of Limitations and think that this company cannot chase me so long after the fact ?

Is this correct and can I write to them and tell them to get lost ?

Yours in confusion ....

The Office of Fair Trade say that if a company has pursued a debt continuously then the normal statute of limitations of 6 years should not apply. The question is if it has taken them this long to track you down or if they have only just started chasing it.

If it is a fraudulant debt though you should deny the debt on these grounds rather than on limitations which would almost certainly be seen as an admission that there was some liability in the first place.

  • great thanks for the advice. They only started chasing very recently, and certainly I didnt know anything about it before this.
