i sent off the letter in reply to B cards attempt to only stop calling me for 28days.I added "I withdraw my consent" paragraph.This was dated 8.1.10
I have had 2 calls tonight and wondered where do i go now
It was around the 6/7 jan that you kindly advised me but i cant find the original post

    You need to give upto 28 days for it to take affect.

    Under the DPA you have 21 days to respond to this request, and 28 days to cease processing and/or remove the data from your systems.

    They should respond to state they will remove your data, and within 28 days after they recieved your letter it must be removed unless they can provide a valid reason such as no other means of contact available, but if they have your address they can write to you.

    You may get phone calls up until very early February but after that they should not ring you. In the meantime just state you want everything done in writing sent by post, and that you are refusing to answer security questions so they cant speak to you on the phone.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    Just bear in mind as a result of the recent rulings, it 'appears' lenders are allowed to hassle you for repayment of the debt if claiming unenforceability - although it is unenforceable and this means they cannot obtain judgment against you, they feel they can annoy you and pursue the debt other ways.

    What this means in laymans, is that they will carry on hassling you regardless of your quoting the harrassment act etc - they will use the recent McGuffick v RBS ruling to combat this. However you should still record the details of each call, and to get them to stop simply block their number or answer incorrect security questions....

    Your name: Why?
    Date of Birth: Why?

    Get the idea - soon they will get bored and hang up on you if all you say is 'why'. They aren't intelligent enough to hit you with closed questions so 'why' will answer whatever they ask you!

    If they ring again, you could handle them as never-in-doubt suggests. Or you could just get to the point where you establish it is them calling and say "Hold on, I'll just go and make a cup of tea and give you my full attention", then put the handset down by the side and leave it for 10 minutes. If they are still there, just apologise again and say you have had your cup of tea and you are sorry you forgot them, but now you have to go to the loo and repeat the exercise.
