Hi I'm new here, have spent the last week reading and hopefully now understand CSA matters much better. Thank you all for the many helpful discussions I feel much better equiped now
I'm a nrpp and we have recieved a variation application of Assets, Income not taken into account, diversion of income and lifestyle inconsistant. PWC is making lots of horrible claims and unfair allegations (3 additional info pages). I understand that we need to make a reply to every claim and statement she has made but I'm not sure how far to go? ie she states we go snowboarding every Jan and to portugal 2 yearly do I just say we have never been either snowbording or to portugal or do I explain that I did win a snowboarding holiday which was booked but we couldn't go on for medical reasons and that we went to spain last year which was also a competition prize and therefore of no cost.
many thanks

I would give as much info as you can, so they arent writting to you all the time with more questions. Also supply proof if you have it. IE a photocopy of the prize letter, or a email print out etc etc.
Also maybe a copy of your passport pages which will show you havnt been to portugal.0 -
The comp promotors should be able to verify it was a prize

Thanks both, not so worried about proving win as even if for some reason I couldn't I don't think 1 weeks holiday in spain over 5 yrs counts as excessive lifestyle. I'm more worried about generally how much info to give. Should I say "we have never been snowboarding or to portugal" and leave it at that or should I expand and give further info (possibly further ammo!). Theres a lot of false allegations including ones against me accusing me of diverting income into my childrens bank accounts0

Wow, if you are (as you say) not guilty of what you're all being accused of, how awful
Does it advise you in the letter what you are supposed to do? What proof they want etc?August GC 10th - 10th : £200 / £70.61
NSD : 2/80 -
They have asked for the last 2 yrs accounts for our partnership income and his own accounts for self emploment and also for his comments in responce to his comments.0

If you don't supply this info, CSA can make a decision on facts you supply, ut then PWC can request an Appeal, and you could probably end up in front of a Tribunal whhich will go into much greater detail than CSA ever do, so up to you, but in our experience for less hassle tell them what has happened supply as much evidence as possible, and PWC will probably appeal anyway, (ours did and lost!) but keep your end right. Send all evidence as recorded delivery, keep Royal Mail barcodes to print off and have a copy file of everything0

Thank you, I've got to post everything tomorrow to comply with their stupidly short dates - 10 days from date of letter including 2 sets of potential postal delays doesn't leave a lot of time, esp when as always I had left completing the tax returns till the very last minute!
I have included all the info they've asked for, and have now found and printed my email notification of the prize holiday. It was only his reply to her 'comments' that I was worrying over, I'm really hesitatant of giving her any more info about our personal lives than absolutely nessicary, but we've gone with the full explaination of everything theory anyway.
Surely theres nothing else she can do to use now anyway she and her family have already made false allegations to the police of abuse, contacted all our neighbours re the same and launched a social services investigation leading to a short term entry on the child protection register, had his driving licence investigated and tryed to start a tax evation enquiry oh and conducted a hate campaign by text from disposable sim cards that lasted through 3 changes of our phone numbers.
Luckily none of the s**t they have thrown has stuck as we have done nothing wrong, I always knew that once they forced her off benefits (their daughter has now turned 12) she would go for the CSA, unfortunately OH didn't believe me and has been paying her support in bills and lump sum cash, silly boy I know:(
Sure the CSA can't possibly match the £300 per week she tried getting through a soliciter first (OH self employed on approx 15K) he would have to be earning something like 120K!
Anyway thanks again to every one on this forum, reading everyone elses problems has helped me put mine in perspective.0 -
Sounds like you have the same PWC as ours0

if the pwc is claiming deprivation of income or lifestly inconsistent, then unless she has proof of this, the appeal will fail.
all you are obliged to provide is wage details for the nrp.
are you LTD by any chance??NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.
and, please. only thank when appropriate. not to boost idiots egos.0 -
Assets, Income not taken into account, diversion of income and lifestyle inconsistant is what they've listed. Proof appears to be a notebook with 'to do' lists that must have been stolen out of my van and they are attaching all sorts of sinister meanings to lines like 'ph xyz re release of retention'. She thinks that the house we live in is an undeclared asset because its worth more than the 65K threshold. Mind you she also thinks they are also going to investigate my tescos clubpoints - they'd be welcome to them only got about 2 quids worth:)0
