Hi all, hope someone can assist me here. I started to involve the CSA in May last year after my ex not paying for my son for 10 years, his 1st payment was paid August 2009 time.
We usually get my payments around the 18th of the month.
12th Jan my son got a payment that was his usual monthly amount but I was quite suprised it was early.
13th Jan he got a payment of £40 - so i questioned this with them (CSA) and was told it was arrears that they have only just passed on- but arrears are included in his monthly payment
Friday last week my son got another payment for his usual amount.
So in 1 month he has got his usual payment twice and an additional amount for arrears.
His monthly amount should include arrears anyway... so cant see where the £40 came from
CSA are adamant that the payment he has got is right. But how can it be if he has got paid twice his regular amount plus an additional £40.
My ex mentioned last time i spoke with him (Nov sometime) that his work had changed/were changing how he was paid so he would get paid for a 4 week month, then a 3.5 week month to bring his employers paydates in line with rest of the company (about 6 companies all under same umbrella)
So i am wondering if this may be the cause, but still - i think we have been over paid..just cause he has additional paydays due to short months should not impact my sons payments.
I dont speak to ex so cant ask him, i did text him to see if he knew why our son should be due an additional payment but had no reply
Now, although this money could not of come at a better time as he has school trips he would love to go on that i couldn't afford i dont want to allow him to use this money to pay for the trips and then the CSA tell me i owe it them back. I know i could put the money to one side and then give it back if they say i need to, but as i say if it is payment due to my son then he could go on the trips, otherwise he cant
Any advice as to how to handle this?

I have received some overpayments of CM with arrears. The CSA told me that they cannot explain it - that is what they have received under the DOE and that is what they pass on. When I asked if I would be required to repay any amount that I received in excess of the normal amoount, I was told that because there are arrears on the account, I would not have to pay anything back, but the arrears would be paid up slightly earlier.
At one point, I received the correct amount (40% of ex's wages), followed a few days later by another £300. The company had paid me in error, but again I was told that the amount was automatically taken from the arrears and I would not have to pay it back. I was concerned that my ex would have almost nothing to live on 9he is low paid) but was told that the company will have to claim the £300 back from my ex's wages after the remainder of the arrears are paid. They cannot claim it back any earlier because they have to leave him enough to live on and also it was the company's error, not that of either myself or my ex.0 -
If there are over £40 total arrears then surely the CSA if they have made a mistake, would just reduce the total arrears by £40. It would be more hassle to change the Payment Schedule. I don't imagine they would be able to ask you to pay it back if it is their mistake.0
