Csa!

Hi
My partner lives on his own and has a mortgage he is currently a student, so he getting help off his family to pay the mortgage. His ex is now saying she wants his to start paying CSA, which is fine but obviuosly as he has no income, he cannot pay anything. Is this correct? Also she is asking where the past 3 years maintaince are?!!!! She told my partner to just buy him things when needed ,which he has done, he has also set up a bank account for him. Also she has never contacted the CSA before and i am aware as shes not contacted them before they won't backdate.Please help.

    I guess you can look at it from both points of view.....

    I wouldn't recommend that any NRP make 'cash' payments of any kind - whether that's buying things for the child in lieu of child support, or giving cash to the PWC - make sure that everything is documented in terms of any agreements etc. I don't think that the CSA will backdate if she has not already filed a claim.

    From the PWC's point of view - if the couple were still together, would the father have been able to quit working and go to school full time? My ex did the same thing, but was unfortunately given an income by the court, as they put it - he couldn't afford to quit work and go to school, as he had two children to help support - which is true, he wouldn't have been able to do it full time, but would've had to do it part time. I don't know if they do that here or not through the CSA.

    Don't start paying any cash maintenance though - not without a receipt detailing exactly what it is for!

    Full time students with no other income have a nil assessment through the CSA, so he would pay nothing at the moment ...

    Once the NRP has finished his course he may well get a better paid job that what he was on previously, so the children will benefit as he'll be able to contribute more than before.

    If she has never contacted the CSA in the past, she cannot claim any backpayment until the day the CSA attempt to contact the NRP.

    Tbh, deal with CSA. They will apply the rules and raise an assessment, based on what is due, and what he can afford. It's nothing to be scared of, and likely to resolve any maintenence situation faster than a 1:1 because it's independent and the ex can't argue with him about it.

    Just do it properly, honestly, and keep them up to date with any changes in income and lifestyle. Most of the CSA horror stories you hear about are because of a failure to keep everything up to date.

    If ex is on benefits then she may not get all that they take off the boyfriend, as they may reduce her benefits. But again, if you do this through the CSA then what she gets has nothing to do with you, and it keeps it objective, and a little less emotional.

    i take it you haven't had many dealings with this "organisation"

    if they were that good, then they wouldn't have been deemed "unfit for purpose" or had their crown immunity taken away now, would they?? throw in the damage they cause to already fragile relationships and you start to see the bigger picture.

    i would advise only using them as a TOTALLY last resort.

    sandiep, please can you tell me when it started to be based on what he could afford, and if they did it by the rules why are there so many sites like this to help people when the CSA have messed up the case??

    It truely must be nice where you are because it is not like that anywhere else!!!
  • I am a little confused as to whats going on here?!!!
    Basically his ex is a con-artist,shes already knowingly got him in debt and is now about to screw him over yet again, sod the fact if they were still together if that was the case his life would not be going anywhere, so the fact he is not with her is a god send! To be honest god knows what state/situation he would be in HAD they stayed toghether! So please can people help with the job in hand.
