Annual leave during notice period

Hi all,
Just looking for some advice:D
I am handing in my notice tomorrow, and have to serve a months notice.
According to my holiday allowance, I will be entitled to 2.5 days by the time I leave.
I have taken one day already, (snow!) and I have 3 more booked during my notice period (OH driving test and moving house)
Now, I understand that I cannot take them all, but am I still entitled to take the 1.5 that I will have accrued?
I'm not desperately worried about the half day, but I certainly need to not be there on my OH driving theory test day, as we are rural and he would not be able to get there at the time that it is booked for.:o

P.S If I hand my notice in on 18th Jan, my last working day will be 17th feb won't it? Daft question sorry, but I do not have to work 18th Feb?:o

    if you're not sure then put in your last working day as part of your notice and then if your wrong your HR will pick up on it

    Thank you, but we do not have an HR dept.........part of my departure reason is the lack of legal compliance within the business.....:o
  • You will be allowed to take your annual leave allowance.....this has happened many times in my company. Otherwise, if it is a busy period etc, they may say they'll pay you for them.

    Your Employer are supposed to honour any holiday leave you already have booked during your notice period. If this goes over your entitlement, they will deduct the pay from your last salary (unless you ask to take the holiday back and work it instead)... If you leave yet haven't taken all your holiday entitlement, they will pay you in your last salary.

    One months notice will generally mean, for example... notice handed in on the 2nd... last day will be the 2nd of the next month.

    The answers are to your question "yes" and "yes".

    Some employers will pay for untaken holiday others won't. So you need to find out their stance. If they don't give you an answer within a week, book another day of any time you feel like it before the end of your notice period.
    I'm not cynical I'm realistic :p

    (If a link I give opens pop ups I won't know I don't use windows)

    Mmm, not sure of their stance, will have to ask tomorrow. I will be the first person EVER to resign from the business. MD has sacked everyone else that has left. Averages over the 3 years of trading, approx 1 person every 7 weeks. Nice.:rotfl:

    I'm not a legal employment expert, but I don't think that you can insist, even if you've already booked them, because your employer didn't know you were going to be leaving at the point at which they approved your booking. I doubt if they'll make much of a fuss over a day or two, but if, for example, you'd had a fortnight off, you could understand them arguing that if you carried on with the holiday then that wouldn't leave enough time to finish your work and/or hand over to someone else....

    If I was in your place, I'd remind them that you have some holiday booked and state that the fact that you have now handed your notice in doesn't alter gthe fact that you want that time off and see what they say....

    I wouldn't normally suggest this but, if it really is as bad as that, I'd be tempted go sick...........

    Teh temptation to hand in my notice tomorrow then leave on Friday after I have been paid remains forefront of my mind! :rotfl:They are going to make my work time a living hell for my notice period, and I sincerely hope that he puts me on gardening leave, although highly unlikely!:o
    I fully expect his reponse to be "F*** off then" and not pay me. In which case I'll have to persue him, but I have seen him be very "heavy handed" :eek:with ex employees to avoid paying them once they have left.
