Mp3's. cameras etc and the 16 day excempt

As all MP3 players, cameras etc come with software would there be a way around the 16 day excempt policy if you didnt agree with the software licence.
If you dont agree then you cant use the product so in rights should be able to take it back. It happens with windows OS if you disagree you get your money back for the OS.

Or if you didnt agree with the licence would you have to return the item to the manufactures

    Argos dont have to take any items back unless faulty so they can stipulate the 16 days return rule and what can/cant be returned.

    The only way around this is to buy over the phone or on the website then the 7 days distance selling regulations come into play and you can return goods within 7 days unused for a refund less p+p
  • the other way is just say its faulty disk. they cant prove it works
  • also there are also the implications that 'has the camera been used'? i used to work for argos and when they started selling camera phones and digi cameras they did allow them back (2002 - 2003) till..... someone brought a camera and found 'adult' pictures in the memory, and what made it worst it was my store (while i was working there) :mad: I think its a good idea on argos' part.

    Also i begs the question that these people that try and return something because they didnt like it/didnt have the features they wanted, why on earth they didnt research the item before buying it.....

    Maybe they do not access to the internet or other high street shops because they live in a rural area, poor etc. Maybe they buy the item as a gift.

    I bought a DECT quad phone set from Currys for £150. It was classed as "crystal clear sound" but was in fact shockingly bad.
    They told me that I couldnt have a refund as the box was opened. The helpful girl said that you dont need to open it because "we have a plastic one on display".
    Sometimes there are things that you just cant tell until you try it. Its a tricky subject. I would hate to take it back if I was the retailer, but its equally annoying getting a poor product as a customer that you cant take back.

    Research isn't the same as seeing the item in operation. Given that Argos don't have sales assistants to show a product fully, or let you test the features before you purchase, there are lots of times when something doesn't meet your expectations and you should quite justifiably ask for a refund. Particularly when Argos don't always fully state the products features and limitations.
    You don't get medals for sitting in the trenches.

    I think one of the reasons that more and more items are excluded is to cut down on people "doing an Argos" - buy it, use it for 16 days and then get a refund.As for the above problem with the DECT phones - you are entitled to an exchange or refund by law as it is not fit for purpose.

    argos can be quite leinient with returns, i often exhanged things with no receipt.

    i think they are within their right to refuse certain things for a refund, i mean if you buy a watch, and after a few days decide you dont like it then you should be allowed to return it, but things that can be personalised ie mp3 players, pc's, camera's etc should be refused.

    though argos should make up for it buy havin specialist sales assistants or better qualified customber services rep's to better advise you before you buy things that they will not return.

    i used to work for argos too, and found that the best way to return items via the delivery system. you would lose the delivery charge though, think its gone up to a fiver now.
