LILA bankruptcy in Scotland

Hi Citizens Advice Bureau have advised that I set up a LILA claim as I owe about 10K to the bank and meet the criteria (low income, low assets and my bank have threatened to take me to the court and make me bankrupt).

The price is 100 pounds.

My question is: Does the fact that the CAB have advised me to do this, mean that my application is likely to be successful? Or is there a chance that the Accountant of Bankruptcy will reject my claim? If this happens, do I get my 100pound back? I can't really afford the 100quid fee but I'll pay it if it's going to help me sort this out.

Does anyone have any experience of being denied a LILA after paying the application fee?

I have good faith in the people at the CAB so I'm presuming that they wouldn't advise me to do this if it was likely to backfire...

Thanks

glad to hear that it all worked out for you. I hope to be in the same boat soon. :)

how long did it take to sort it all out (from the time you paid to the time you find out how the application has gone)? just wondering.

also, were you worried that your application would be rejected? is it possible for the bank (my creditor, TSB) to reject the claim, in an effort to 'hurt' me.... one last twist of the knife if you will
  • Hi zoom
It didnt take long at all i think once i sent off the application pack it was only 3 wks and then i just had to send in some photo copies off bank account statements etc
iam sure C.A.B wouldnt have advised you if they thought your application would fail...i never worried that it would fail because cab advised me to do it so i presumed it would be fine , anyway i had no option .
I done a very cheeky thing though......on the day i was to pay my £100 into the bank off scotland...i went into my own bank and drew out the £100 from my already groaning overdraft ! crossed the road and payed into the bank off scotland ( this is where you take the fee )

Can i ask if you have an income ? have cab gave you the application pack yet ?

You put all the creditors on form 17 and it all goes into your lilla (bankruptcy) my bank account was in a state & i havent heard a thing...infact the insolvency people told me they would contact all my creditors

hi i was refused BR....but got there in the end.
CAB helped me fill out forms+i payed £100.
i sold my house in sept 09.then went BR (lila route) in dec 09,got a letter back from AIB saying i was REFUSED BR.the reason was my old house was still showing in my name.
called AIB+explained this about house+they said i would have to wait untill my old house was not in my name then reaply+pay another £100.
went back to CAB,they called AIB+they got a letter from my lawyer saying the house was sold sept 09,
after that AIB agreed that i did not own the house anymore+i was made BR on16/12/09.
    good luck
