Littlewoods Extra still chasing me...

Last year I requested a copy of my signed credit agreement from Littlewoods extra catalogue, and received a letter stating that, as they didn't have it, they wouldn't pursue the debt (although it would be listed in their internal files and on my CR as unsatisfied).

I thought that was the end of it, but no. I got a letter this morning demanding arrears of £707.15, which when I asked what it was for, they couldn't explain. I am expecting a letter from Head office by the end of next week (or so I've been told...hahaha, yeah right, I'm sure it will turn up:p ).

If I have got a letter in writing stating they weren't gonna pursue the original debt (£900 ish), does that mean the account is still open and, furthermore, can they still add charges onto it and chase me for these?

Nobody I spoke to (I lost count how many depts I was transferred to!) could give me an answer.

Is it me being stupid, or them? Oh well, lets wait for a phantom letter to turn up...lol

    I've just had a phone call from Littlewoods requesting me to pay the "arrears" by debit or credit card. I still have no answer to where these charges came from.

    I did think that once the original balance was unenforceable, then any charges on this (if that's waht they are) aren't enforceable, either?

    I admit I did run the original amount up in spending, but also in penalty charges (which I'm thinking of claiming back). The only reason I didn't carry on paying it is because I'm ill, on benefits, and currently trying to shift a whole lot of debt with what little cash I have.

    Can anyone shed any light on what Littlewoods can or can't do...please?

    I would have thought that if they cannot prove you had a debt with them in the first place, charges are irrelevant?

    Write a letter to them, with a COPY of their letter stating that they would not persue the debt and request that they either cease from contacting you again, or you will be happy presenting the evidence in court should they decide to take it that far.

    You cannot claim back charges - if they cannot prove you owe a debt, then there is nothing for you to claim back from.

    Not sure where you stand here. They seem to be saying that they can't prove you have a debt so will not pusue it but are going to record it as a continuing debt internally and on your credit report. Seems to me that they might be on shakey ground doing that.

    I notice you don't say that it is not your debt so are you just trying to get out of paying for goods you have received?

    Saying they aren't going to pursue the debt doesn't sound the same as writing it off - maybe just that they don't think it's worth it. Could be keeping it going and adding charges and such and will at some point sell the debt. The letter you got could be part of that process.

    You might want to get advice about this.

    Sorry to be harsh but I don't understand why you won't pay the debt you ran up. You could reach an agreement where you pay reduced payments without incuring charges or interest.
