Debt Recovery Agency Advice

Hi all,

I've been paying a monthly sum to a debt recovery agency for about 10 months now.

They were recently taken over by another agency who really do not seem to have their act together.

First of all they asked me to send bank statements to prove that I had been paying, which I did, along with a letter asking them to only correspond with me in writing. They have the statements but say they didn't get the letter (it was in the same envelope!)

Now they ring every month to say they can't find record of the payments and can I send them bank statements. I tell them no and then they miraculously find the payment that I've made in their records! They never seem to make contact at the same point in the month, sometimes it's the day the payment was made, sometimes the day after and sometimes before the due date. They rang on December 1st to tell me they hadn't received December and it's not due until the 18th!!

So, my question is, can I send them a letter asking them to send me my original paperwork even though I have been paying them? I'm pretty sure they are so disorganised that they won't be able to!

    Yes you could still do a CCA request if you want to - what was the original debt for? CCAs only aplly to certain debts - read this thread for guidance/tips/implications. http://forums.moneysavingexpert.com/showthread.html?t=2060575

    For future reference I wouldn't send bank statements out to any DCA no matter why they say they need them.

    The debt is for a home learning course that I signed up for but then defaulted on.

    I didn't learn anything either!
