Refused bankruptcy?

Hi Everyone,

I managed to submit my forms this morning and paid the fees. However, the court clerk said that because I have failed my IVA, the Judge may not make me bankrupt today and may want to have a hearing or listing in 2/3 months time.

Can you tell me if anyone has been through this or refused bankrutcy? I am so scared - I had already attempted suicide once and I am worried that I could not cope if I could not get the bankruptcy through today.

Please can someone tell me if anyone has been refused bankruptcy before?

I just want a new start...

Try to stay calm, (easier said than done, I know) nothing is worth taking your life for, and believe me I have thought about it as well. You say you have a failed IVA, so do you have the certificate of failure? From what I can gather without this certificate it is highly unlikely you will be made BR. Please ask any and as many questions as you need, someone will always be here to help and support you.

i tried to take my life on numerous occasions in 2004 because of debt was locked up in a pschiactric ward for 22 weeks then all the debt just followed me around finally bankrupt july 2009,just hang on in there there is light at the end of the tunnel and help from special services if you need it,explain your situation about your health to the people you owe the money too ask them to back off until its sorted put it in writing also saying its being classed as harrassment because of your mental state,ask them for a couple of months grace by which time you should be able to file properly,hope it helps you be sensible its only money you owe not your life(god bless)

Hi dojoman, I went yesterday and did not have the Certificate with me - I went again today armed with the certificate, forms and fee. Then the court clerk told me - don't be surprise if the judge did not make you bankrupt today - some judge is O.K and some judge is a bit funny with IVA! I just hope and pray that the judge will make me bankrupt when I go back at 2pm today. Help!!!

Hope it all goes well for you this afternoon, I may be wrong (often I am) but I thought as long as the IVA had failed, and you had the relevant documentation, and that you were insolvent that the judge should sign your BO. If I am wrong hopefully someone will correct me.

Thank you dojoman, I have been continuosly chanting 'pls make me bankrupt today' for the last hour and hoping that GOD will hear my prayer and answered it at 2pm today. I will keep on chanting until 2pm.....

I failed my IVA and my creditors petition for my BKO on the 29/12/09. I wasnt able to attend but received form 6.25 stamped by the court. This forms stated upon reading the evidence it is ordered that I be adjudged BKO!

I am sure you be fine.

Not sure what evidence was heard as hearing was 12:30 and time I was adjudged BKO was 12:33.

i'm sorry to hear you're so down. just know that the debt issue can be resolved, and it is definitely not worth taking your life over...please see your doctor if you're feeling low

Thank you everyone for your support and kind words! As you may have seen my latest thread - I did it! I am bankrupt today at 2:45pm! I am so grateful to all of you who have been so kind to me all these months.
