Hi All,
I was wondering if anyone on here has successfully challenged the Local Authority in respect of nursing home fees and succeeded in securing NHS continuing care for a relative or not? We have been having an interesting debate on one of the threads about preservation of assets via Wills but thought it easier to start another thread here. Apologies if this has been discussed elsewhere, please direct me there! Cheers!

We successfully made a retrospective claim for costs paid towards the continuing care of my late father. The basis of the claim amounted to the fact that there was a medical need for care and it was not just down to disability. As medical needs should be met by the NHS without charge, the NHS should have been paying for the care.
So basically you have to prove that the requirement for care is based on a medical need. We didn't use a solicitor but we did a fair bit of research using the internet first and then made the claim to the local health authority.0 -
Appeals of this nature are rarely upheld, and for good reason.poppy100

During the research I carried out before making the appeal I found league tables on percentages of cases upheld in different parts of the country.
It's true that on average most cases were rejected, but there was huge variation across the country with some areas rejecting a much higher amount than others. Thats why (I believe) there was an independent assessment available where final appeals could be made if people weren't happy with the original decision.0 -
This issue is usually discussed on the Silver Savers board where there are several threads advising on how to mount a case.Trying to keep it simple...
