question about my barclaycard debt-HELP!

Hi- i am still planning on posting my s.o.a- will be v soon, but in the meantime...

I was wondering if anyone knew the minimum i should be paying per month on my barclaycard.

It is now with a debt collection agency

The total amount i owe barclaycard is £998 and the credit limit was £800. i sent them a financial statement that my partner filled out for me using the giude sheet from the cccs.

However he did not do it correctly. he missed things out and estimated far too many things. Stupidly i just signed it and sent it.

Now they say the minimum they will accept is £75 per month or they will refer me to a doorstep collector (is that a bailiff?:cry: :sad: )

he said my only other option is to pay a lump sum one off payment to clear it - and he'd reduce it by 40% making me owe £596 so at end of july i could clear it by paying £521.40 (as he still wanted me to pay £75 this month too which he said would come off it)

He only said this as he reduced me to tears on the phone. apparantly my partner put £200 per month for cigarettes, so they will not accept any offer i make them, as they say i should really spend the 200 on paying the debt off.

so what do i do? i know its hard without a soa, i am finding it hard to find the info needed...and the time to do it.

I never have any money left at end of month though. I have cut up my cards. i oew money to so many things. Not as much in total as some of you but enough to keep me awake at night.

I don't work, my partner does. these debts are in my name only. he has a couple too. i doubt anyone will make sense of this but i had to try. At least my marmite freebie was on mse newsletter this week- that made me smile:j

i get middle rate dla on behalf of my daughter aged 6, and carers allowance
for looking after her. other than that my personal income is child tax credits of 120 pr week. i think it works out i get total of 800 per month. partner pays rent.

    we owe 3500 to barclaycard and are paying 57 per month but this was a battle to get them to accept

    Firstly dont panic and dont believe most of what they have said.

    you need to put a proper SoA together so you show your creditors that you have very little spare money to pay off your debts. obviously you will keep a copy of it.

    i'm afraid to say that writing threatening letters and making unpleasant phone calls is what DCA people are paid to do. Most of what they say is absolute rubbish and is just not going to happen; but it is designed to frighten you into paying them more than you can afford.

    What you must do is offer to pay them a sum you can afford, this being fair to all your creditors...if thats £1 per month then thats what it has to be. Make the offer in writing and keep copies of all correspondance.
    They wont like this and will try to pressure you with all sorts of threats.
    Do not let then scare you into paying more...refuse to discuss anything on the phone just tell them to put it in writing and hang up. if they phone back just tell them to put it in writing and hang up.

    Although its unlikely they can apply to the court for a CCJ. you will be
    summoned to appear and will be able to present your SoA and the judge will decide what you need to pay.....as the DCA know this, its unlikely they will actually go to court as it will cost them money. Bailiffs can only get involved if you fail to keep up the payments decided by the judge and only then after another court appearance.

    doorstep collectors have absolutely no power whatsoever...just tell them to get lost.

    but you must write up a proper SoA so you can show your creditors that you have no spare cash (and obviously it wont have any money for cigarettes).

    You should also sit down and have a look at all your statements.

    I'm guessing if your balance is way over your credit limit you have incurred lots of penalty charges which you may be able to pay back.

    I would write back to Barclaycard and tell them that you can only afford to pay £10 per month and pay this regularly until you have your SOA sorted out.

    Please don't take out any more loans or get into detailed negotiations with individual creditors without talking to citizens advice or a debt CHARITY first.

    do a realistic spending sheet do not leave yoursef short.but do not put every thing down ie I put £6 per week daughters dancing class and that was turned down as well as a few others so got in touch with debt line and did a realistic one with them .Barclaycard are really bad at accepting the offers.We originally offered 54 they said this was not acceptable so offered 57 said we could not do anymore and finally after a lot of phone calls they took this .stick at it

    You really need to contact CAB, Payplan or CCCS who will send you details of the information you need, and will help you to complete the SOA. Once you have spoken to them, you will have a reference number to give to BCard when they ring, and they will hold it while you get things sorted.

    CCCS has a wait of a couple of weeks at least, so that will give you two weeks in order to get all the info you need. Not sure what the waiting time is for the others.

    The advice is free, so you should make use of it. BCard have been the most awkward of all my creditors, but I just keep paying them what I previously offered. Haven't heard from them in a while........maybe due to the fact that I changed my phone number!!!!:rotfl:

    He meant that you can claim back any penalty charges levied over the past six years. See this site.
