Can anybody tell me if he is entitled to anything?

Hi all

The company my fiance worked for ran out of money so told everyone to go home and that they would not be paid (owed about a grand). They have been promised this money owed will eventually get through for about 3 months now!

I finally convinced him that it isn't coming and to go to the job centre to see if he can get any money while he is finding another job. He went and was told they would look into national insurance contribution money?
He then recieved a letter last week saying they have looked at the tax period 07-08 and he had not paid enough NI to qualify. probably true as he was made redundant that year and it took a few months to find another job (but didn't bother trying to claim anything)!

He had an interview at the job centre today where he had to go and say what steps he is taking to find a job and i told him to ask about the money at the time but did he? NO! which has infuriated me and he is so money aware usually. He then said well hopefully it won't matter anyway as he has an interview on monday.

I explained to him that even if he does get this job on monday he might get a little bit of money from the 3 weeks ago he first went to the job centre. Even if it is only £100 it would still help us out as we are currently eating slowly into our savings as i am a tecaher in my first year so only on £21,000.

I got through to him and convinced him to phone them which he has and has now said that he was told he could not get any form of job seekers allowance because he lives in the same house as me and i am employed full time.

He would never question them or even enquire as to if there is anything else he can do so i was hoping someone can help me and tell me if he is entitled to anything? money from the government because he is owed wages? basic job seekers? anything?

If he can't then that will have to be fine, but i want someone who knows to actually tell me because he is not actually enquiring and pushing and it is driving me crazy. Like i said, he is usually good with money and we have over £10,000 in saving for a house deposit because he is good at saving (but it is now slowly eroding away)

    He won't be entitled to any means tested benefits because of your salary, plus any he would be entitled to would be eroded by your savings.

  • I'm not sure about this, so someone more knowledgeable may want to confirm or correct me. If your fiance is no longer working for the company, he seems to have been made redundant. I think that there is government help if the firm cannot pay redundancy (but it does depend on how long he has been there). There might be government help if he has not received his last wages as well - ACAS may be able to advise on this. Or is he in a union?

    Otherwise, has the firm gone into liquidation? Presumably he will put in a claim as a creditor if the answer is yes. I know it won't be much - probably just a small percentage and it will not be paid for several months - but still worth checking to see if this is a possibility.

    As a teacher, you may have free legal advice attached to your own union membership - it's worth checking, in case you can utilise it for proper advice.
  • Thanks for the extra replies. I have told him to check with them about signing on to ensure his NI contributions.

    With regards to the company I am not sure if they are technically in liquidation or not (will check in a mo on companies house) but a few other employees went to tribunal for their money, and were told yes you are owed such and such but haven't got a penny as it was a ltd company and the director has nothing left in the business.

    Plus he had only just started working there as he left a job on a rolling 3 month contract to start this permenant job!

    I will get him to contact ACAS.

    If he had only just started working there then redundancy is not a issue here.

    Signing on for NI credits is a good idea though, plus using the JC resources for job help, seeking etc.

  • After getting my employment tribunal judgment for redundancy/money owed[ my ex boss disappeared], I sent in an RP1 form and the NI fund paid me. Can they try that route?
