    Sometimes you end up paying out just to get to exchange. Frustrating that these things don't come to light earlier. I think the solicitors don't go through all the papers until all the ducks are lined up (mortgage offer, deposits, searches etc). They would say its so that you don't end up paying for their time until the purchase is likely to go ahead, but it does mean that these things don't come to light until the last minute.

    My seller's have agreed they are going to pay for something before completion. The two solicitors are going back and for amending each other's words to add to the contract, whereas between buyer and seller we've agreed exactly what they are going to do before competion and a retainer if they don't manage to finish it.

    I just want to exchange! :cry:

    It's so frustrating especially as my buyer's solicitor has had this contract documentation for three months.

    Now you'll probably think I'm now worrying unnecessarily but does this now mean my buyer's solicitor will want to see boiler service records (which I don't have) or something else? Or is enough enough now....?

    I would think they should have asked for all the papers they want, even if they haven't read them.

    I know they ask for recent water bill as proof that you are connected to the mains and sewers, I don't think they NEED to have boiler service records.

    yes I've provided utility bills and council tax bills.

    My solicitor called yesterday with the queries, they were for the extension (as we've discussed) and about the window guarantees so I assume if they'd of wanted other stuff, it would've been raised with these queries?

    Well if I get another call about the boiler or electrics (or what I like to eat :)) I'll come back for advice. Just feel like I'm in a corner at the moment and have no choice but to keep agreeing to stuff :(

    We were asked if we would ensure that the window guarantees would be transferred to the new owner. The windows were put in by a local guy whose office is based less than a mile away. I was so fed up with the nonsense, I replied that the buyer should make their own enquiries. Didn't hear another word on the matter.

    We were quite friendly with our vendors up till the week of exchange. I had my solicitor in place the minute I decided to sell. My vendors took two weeks to get a solicitor in place. It then took her another two weeks to request the sellers pack, which was waiting to go. It was the Friday before exchange that the vendors finally went in to bollock her for holding things up when she finally decided to open the stuff sent and decided clarifications were needed which of course my solicitor didnt hear about till the Monday. She then had the cheek to tell our vendors that she had previously requested the info and that it was our solicitor holding things up :mad: This caused no end of bad feeling when our vendor decided to vent at me - tbh he positively scared me :( And to top it all when I should have been spending time with family and friends I was in fact wasting time chasing answers to stoopid bloody queries that should have been dealt with 3 months previously

    Thats why I had no hesitation in pulling out the day before exchange. Id bent over backward to accomadate, even going as far as agreeing to give them the keys two days before completion so they could clean their rented accomadation, I even gave them a whole suite of new bedroom furniture, the garden tools, lawn mower, shelves around the house,dishwasher, set of coffee tables, etc as well as the included in price carpets/curtains.His rudness was totally shocking and scarey. Come the day he picked up the keys i couldnt even go into the same room as him and i didnt leave the champers for him :)

    We would never have been like that with each other if the solicitors had done their bit and stopped passing the buck

    I say never again but I bet I do :)

    and why do solicitors insist on writing to each other - it would be so much quick to speak on the phone surely???

    I know that no-one can really advise me what to do at this late stage, but "if" other issues crop up, shall I stand my ground a bit. I know it's usually the solicitors causing these problems but I'm sure my buyer isn't going to want me to want to pull out this far down the line?

    You're right, your buyers wont want you to pull out and theres really no need to. I just did so because of the way I was treated by my vendor. I can understand where his anger was coming from, he was new to buying and selling in this country and just didnt understand the ways of our solicitors, but there was no need for him to have taken his anger out on me.

    The list of queries his solicitor sent over on the Monday was really trival, she could quite make out the boundry line, who maintained the joint pathway (already answered by me) who was responsible for the fences (already answered), warrenty for the DG, boiler service history - already had photocopies, really silly stuff that proved she hadnt even opened the file untill the friday before. And as for the planning permission issue - well dont even go there, talk about talking to a brick wall :)

    But when everyone is this close (and hey my furniture had even gone) no one wants it to fall through and buyers and sellers should be able to work it out and puch their sides to go ahead and exchange

    Your extension may not have needed planning permission in the first place (the Completion Certificate is for Building Regulations) and even if it did, as it is over four years old, no action can now be taken against it as it is now exempt from enforcement action .

    All you need is a letter from your Local Planning Authority telling you this. I've written hundreds in my time in Town Planning.
