Car Hire Purchase, Returning Car after paying 1/2
Hi
I have paid enough on my Hire purchase agreement so am able to hand it back with no further payments etc.
Does anyone have experience of this, as i have been told that the auction place i take it to will carry out an inspection etc.
The car has no MOT or tax and does have one or two scratches. my agreement does not detail any hand back conditions or clauses etc
Will they try and charge me for scratch repair etc or can they

It depends on their terms but I handed my back in October after paying half. They took into account wear and tear but there was a limit on how big scratches etc could be (think it was about 2cm). Mine was MOT'd so not sure about that but it was due its 3 year service and they told me not to worry about that.
It might be best to speak to them and check their terms before you take it back so there are no suprises!0 -
The rules are contained within the termination wording of the Consumer Credit Act.............."you will not have to pay any more providing you have taken reasonable care fo the goods"
In the case of cars, this is generally accepted as the car being in a roadworthy condition and free from mechanical or cosmetic damage save for what would be reasonable given the age/mileage of the vehicle.
The lender is entitled to add a charge to cover the cost of making good any failure relating to the above.0 -

The car is in resonable condition just a few supermarket trolley type scratches.
however it does not have an MOT, the car is mechanically sound and drives ok, i dont really want to go spending out on MOT if i dont need to

The car doesn't need to have tax but you should really get an MOT done, as this can also be used as general evidence to back up your perception of the car's condition should the lender decide otherwise.0

I didnt give myn back with mot or tax as they are not part of the car0

why do you have to take it to auction ours was picked up from the house when it was handed back0

You need to check the terms and conditions of the agreement.
Somewhere there will be more than likely a clause regarding servicing and MOT.
Mine is due back at the end of this month and is due its MOT now. I checked over the agreement and it said it has to MOT'd and have been serviced correctly or they could do me for the decrease in value due to it no tbeen serviced correctly.
That been said it all depends on the companies T&C's. You need to check with them.0 -
