Back in the CSA

I was paying the CSA under old rules for something like 11 years like a good'un until my ex wife and I came to a "mutually acceptable agreement" and decided to stop using them as there was no real gain to herself

We have been doing this for eighteen months or more and as there were no arrears, no further contact with the CSA.

Now relations have taken a nosedive and she is threatening to go back to them. If this happens would it be under CSA1 or CSA2 and when would my liability start?

    As long as you have a letter to say that teh case was closed from the CSA, then my understanding is that it will start from the date that teh application is made, as it will be a new case so it will be under the new rules. Again my understanding is that they should try to get teh agreement reinstated, as now they are the last resort as it were!

    Hope it helps, and that the CSA/C-MEC see it the same way.

    Who can say, they are pretty random after all. I will look for a letter or ring them up and ask for one before it all potentailly kicks off again. They did cancel my Deduction from earnings order so you would have thought that would be that but after having dealt with them before I know what it can be like

    Ho hum, only another two and a half years of this left :rolleyes:

    As Blob says, it depends on whether the case was closed or switched to direct pay. Did you get a letter to say that the case was closed?

    I am not sure if I got a letter, but when I spoke to them verbally they said the case was closed and I have no contact from them since. They also know I am paying way under what they think I should be (eg I pay £80.00pmbut they calculated it as £210.00 pm) but thats OK as thats what me and my ex wife agreed. It was also them that stopped the deductions order from my wages

    I think I will ring up and ask for a letter confirming that my case was closed, tgat way it will put my mind at rest

    the easist way to find out if case was closed is to apply for your files under the Data Protection Act.

    if it was closed and a letter was sent, then the letter will show up. that would put your new case on the new rules.

    no letter and they may continue with the old system.

  • Thanks for your replies, I have phoned them and found out that my case is still open but as a nil assessment This apparently cannot be changed unless either me or my ex wife ask for it, so if she did have the hump I would be assessed under the old rules.

    I will see how things develop, thanks for your help

    Ah well, at least you know. I had a sneaky suspicion that would be the case if you had no letter. The case would have to be closed for at least 13 weeks to be reassesed under the new rules.
