Requesting Original Finance Agreement

Hi just a quickie,

Is it possible to request the original finance agreement and not just a copy of it?

I have in my posession a photocopy of a fax of the finance agreement but it is not clear and the legitimacy of the finance agreement is in question.

Also is there a special letter to request the original or will the usual template letter suffice?

Any help would be gratefully appreciated.

    if I read this right, they are not going to give you the origional......please
  • Under a ruling in the recent week, there is now no requirement for the lender to supply a copy of the original document but they have to provide what were the terms that agreement was made upon.

    Fermi - So the photocopy of the fax does not constitute as a copy of the original agreement? It should be a photocopy of the original which is clear and legible then?

    Yes I do want to get the original agreement is this possible as my solicitor requested it and his request was ignored even though I gave the finance company my permission to release any information that they hold on me.

    Under which piece of legislation was it requested?

    - Consumer Credit Act 1974?
    - Data Protection Act 1998?
    - Or just requested without mentioning either of those.

    What exactly is wrong with the copy of the fax? Is it missing something? Is it illegible? If illegible, was the original fax so?

    Really need to know more so that we can work out if what you have been sent is sufficient under the first request, and to work out if another way might be better.

    Obviously if the legitimacy of the agreement is in question, the creditor will do the utmost to try to muddy the issue in what they provide if they think they can get away with it.
