Very quick question - Natwest wont let us get child benefit money

OK, quick heads-up:

Wife and I have 3 accounts with Natwest, but are in a financial mess. One account is a loan (circa 13k with about 2 months arrears), second account is a current account with circa 5k overdraft, third account is a savings account.

Natwest have contacted us, suspended our accounts and want the cards back - not a problem for us in itself, BUT the savings account is where our child benefits and tax credits go. Can we ask Natwest for this money since it is required for us to provide for our children?

    next step is to open a cashminder account and transfer all benefit payments to that account..
  • not yet, my wife and i have a meeting with CCCSVA on the 4th but assuming our Creditors wont accept an IVA of less than 14p in £1, we will be starting the BR process.
  • too be honest then I do not think you can ask for this money back. You owe them money as your not BR. Iv only known cases after BR that benefit money has been refunded.

    Im not 100% but i think you have lost it.

    Usually if you have defaulted on your debts with the bank then they can set of any funds that you are holding with them

    I am not 100% and my brain is fuzzy from lack of sleep (ill child) but I am sure that there is something that means that you can write them a letter and as it is benefits then you claim them.

    Hopefully blind as a bat or fermi will see this and will be able to tell me if I am wrong.

  • Under the Social Securities Act, it is illegal for a bank to withold any benefits paid into it for the purposes of paying off debts or charges.
