I am just preparing my charges to send my prelimanary letter. The bit i dont understand is e. g. DR interest til end of june 01 £5.06
do i claim this or is this interest for an having an overdraft? Sorry i have looked on the consumer site and cant find anything.

You should be claiming for charges for missed DD, exceeding your OD limit and cheques not cashing. When you send your letter asking for repayment you do not inculde any interest on the amount you are owed or interest for having an OD and using it month to month.
You will claim for interest at 8% once you get to the point where you are making a claim through a court or through money claim.

It actually depends, if you don't have an overdraft or were forced to use it because of unpaid dd's etc then you can claim the interest they charged you, back straight away.
The 8% is different to this.

Sorry to hijack thread but didn't want to open a new one for this subject, I would like to start claiming my bank charges back, not much £200 or so.
Has anyone had success with Intelligent Finance, I am concerned of course that they will close my account, I do have ISA's with them as well, and I am thinking of possibly transferring my mortgage back to them in Sept, does anyone think they will close the account or will they want my business with the mortgage and the likes.
Also claiming your bank charges back, does this in anyway affect your credit rating, Its possibly a stupid question, but so I am clear before I leap in head first.0 -

In my own experience, i haven't had my account closed, this was with halifax and i think it is because i have other products with them. I have known others to have their accounts closed though but hold no other accounts, mortgage savings etc.
Go for it, it does not affect your credit rating as it is an unlawful act, they cannot and should not put anything on your credit file to reflect this.
Who is IF run by, if you look on the consumer action group website you may see other cases with this company that will give you an idea of how they handle these situations.

you cannot claim back the interest on your overdraft, but I understand that you can claim back the interest charged on any unauthorised overdraft. You will find lots of information and discussion about this at https://www.consumeractiongroup.co.uk
If you are unsuccessful with your initial approaches to the bank and have to proceed with raising a claim in the small claims court, you can then add on statutary interest of 8% on your charges.

This is what confuses me I have an overdraft always in it every month. I have had hardly any months without charges which either takes me into my overdraft or increases my useage. At one point they have charged me £120 for the months interest. So this is why i am confused if i claim it back or not? Am i as clear as mud
