what to do

ok slowly paying off stuff that we owe and each month the figure goes down and it all going smoothly. only problem is with one company at the moment - (the moorcroft group) they hold the debt for hubbys creditcard it had balance of £280 on - i made minimum payment of £50 when the statment came in at beginning of this month (had missed two payment for previous month and incurred the charges:rolleyes: tried to explain that we were waiting for ousing benefit payment to come through but no good) anyway couple of days later a letter from moorcroft come sthrough for £280 - phoned them and they wont settle for less than £120 per month and an initial payment of £30 today!!! told them i had already paid £50 this month and could only afford max £60 per month but to deaf ears apparently! this morning recieved a payment book from them with payments of £120 per month to be paid or else they will proceed with legal proceedings:(

what can we do - i tried phoning credit card company (vanquis) but they said its out of thier hands. i know its not a huge amount of money but i cant afford to pay it off at that rate.

    I don't know what they can do legally, but I'll tell you what I'd do (and have done) - carry on paying £50 per month, get caller ID on the phone and ignore phone calls from them, and keep letters but don't respond to them (dunno if not responding to letters is a good idea but it worked for me).

    I decided I was in control of my cash, not them :D

    its very unlikely that they would take you to court for what is a relatively small amount.
    even if they did its very likely that a judge would consider your payment of 50 per month reasonable and may even make an order for a lower sum ...and they know this.
    trying to frighten you into paying more is what they do every day ..its their job
    so pay what you can afford and dont be frighten or intimidated by them into increasing your payments.

    Agree here - if it did go to court, they know that your offer of £50 would be acceptable - they are just trying scare tactics.

    Carry on paying the £50 and ignore the calls - good luck!

  • You could put the offer in writing along with a cheque for the next payment, in the letter ask if they can do all communications in writing so you have a copy to take to your CAB advisor. They seem to change tactics as soon as they think a third party is involved and that what you are offering is a more than fair offer. Good luck

  • Hi there davesgirl, we have adebt collection agency called TBI Fiancial that we have been paying a debt of £1290 for the last year,we asked for a statement recently as I keep records of all payments and to our horror discovered that an interest payment of nearly half the original debt has been added we had no notification of this so i am in the process of sending a letter with a cheque of £17.32 to claer the original balance and I am also going to add that the interest payment will not be paid because as far as i can see it is unfair and will submit a complaint to the OFT under the Consumer Credit Act 1974 upon the basis that you have failed to comply with their direction of 5 April 2006. I will let you know how it goes. but to end on a good note I actually got bank for my son bank charges totally £307 just this week........Hurrah for the little people!!!!

    jayne1966 - great news about the bank charges
    well in the end last nite i juggled a few other things around and made them an offer of £200 full and final payment - they accepted straight away, wish i had of offered less now:rolleyes: anyways its got them off my back and free's up £50 a month to pay onto other stuff now i guess:o

    Make sure that they send you written confirmation that this £200 is full & final settlement of this account & that there will be no further communication regarding this matter.
