Rossendales Bailliffs help?!

Need some advise on how to deal with a debt collection company and their bailliffs.

I am in a lot of debt and am really struggling to keep my haed above water, one company is persistantly calling and sending bailliffs round to seize goods and make inventories. Most companies, if you explain that you have little or no money, will arrange something that is just about affordable, however,one company wil not do this.

Long story short, I am one of the unlucky one that have been to court for benefit fruad, before you judge, I worked for 4 days at a temp agency, told the council they said don't bother filling out the form unless you do any more work for them, I didn't, 6 months later, I was in court for fraud for not declaring it. Court agreed that it was unfair and threw the case out, 2 months later get a letter saying I have to repay all benefits I have recieved for the last 3 years. Total £15000. Problem is can't fight it without bank statements and reciepts for everything going in and out of my bank account, right down to the second hand clothes I sold on EBay, apparently I had to declare that as well.

The issue is, because we moved around a lot (6 addresses in 4 years) the council and debt colectors have divided it into 12 debts (6 for council tax benefits and 6 for housing benefits). They can see my finances and think that I am able to pay £25 per month, which I can, but they want £25 per month on each account totaling £300. They are refusing to take smaller payments saying that is the minimum they will accept and they send the bailliffs round once a month to make inventories charging me £24.95 per account per month for that.

They are refusing to combine the debts, insisting that I have to py each on seperately. I am struggling to pay £5-£10 on each account via the payment slips they sent me, trying to make good will payments until something is sorted, and I thought that I was getting somewhere until the bailliffs turned up again yesterday.

I am at my wits end with this, I don't know what to do for the best and everytime I try and call the company, they say that they cannot discuss it, to contact the bailliff, and everytime I call the bailliffs, they tell me to arrange a plan with the company.

Desperately needing help with this, the debt is just getting bigger and bigger, despite my best efforts.

    Please don't panic. First thing is sit down, take a deep breath, take out all the paperwork and call CCCS or another company that can help you through this. It is not the end of the world, you can get through this.
    CCCS or another debt advice agency will be more than willing to help you, represent you and set out a suitable affordable plan of action.
    Also please contact the bailiffs and debt collectors by letter only. That way they cannot stitch you up with half truths by intimidation and bullying tactics over the phone. I believe you do have rights and the bailiffs cannot enter your property without your consent. Keep them outside the door. I wish I was a legal eagle then I can give you more solid info, but I know that there are a lot of decent people that can give you the right advice. Be hopeful and don't let them steal your peace at this time of year. I will be praying for you too.

    First, I'd like to I got the creeps when I read the title.
    Simply because I gave birth to my baby girl earlier this year and called her Paige, and I've had dealings with Rossendales...


    I emailed my local council asking for their help (my debt was council tax debt), explained the situation and how unfair Rossendales we being AND EVEN PRACTISING ILLEGAL STANDARDS WITH ME!

    My council recalled the debt and set up a manageable sum with me.

    I know my post won't be the biggest of help, but I'm no expert and can only advise on what I have personally done/been through (and again, really creepy!!!)

  • Thanks for all your help, but the balliffs are due around again on Tuesday to make yet another inventory. Now, I have 2 kids, 1 t 2 years old and another at 11 weeks old, so what items exactly are the balliffs allowed to take from my house if they have a walk in possesion letter?
    I dont want them taking any of the xmas presents or furnitutre, etc, and certainley not any of the kids stuff!

    Rossendales are and have been so unproffesional when you call them, they sound so common and a bunch of thick chavs on the other end of the phone reciting from a script and threatening me with more costs and more balliffs everytime. Like I said, this is starting to worry me. I now have been told about yet ANOTHER different balliff coming on Tuesday and I have been given he rmobile number but cannot get hold of her day or night, so now what? She is a Rossendales balliff!

    Who do I now contact about this and Rossendales behaviour and where do I stand?
    To say ive had enough is an understatement, my partner is ready to do unspeakable things to them on the doorstep when they come around!

  • I never used to answer the door to baliffs.
    You don't HAVE to let her in if she doesn't have a warrant.

    I would still get in touch with the council on Monday and explain about the harrassment. I did and asked them to recall the debt. And if they do, it'll also save you money from the baliff charges they add constantly.

    The Council will be closed till Tuesday. Monday is the bank holiday.

    Call them on Monday (Edit <---- der! I mean Tuesday! lol) and don't let the bailiffs in under any circumstances.

    I'm missing something here...if the court threw this out, how does this mean that they can come up with an estimated amount like that? IF you had done what they said, obviously the court would not have thrown it out. 15k is a major fraud.
    I would get advice on the ROOT of the problem...it shouldn't be up to you to prove anything but them to prove where they get that stupid figure from...again, the court obviously didn't think it was right did they? You CAN prove that part after all. Court judgements must have some weight and also are public record.

    Don't struggle and worry alone, go and get some proper advice and help. As already advised....don't allow a bailiff in. Do that once even for a pee and they can enter at will in future.

    I have only just noticed this problem.

    In the first place you have said that a bailiff is due to come around again to do an inventory. There is NOTHING in law that states that a bailiff is allowed to come into the property. You can refuse entry and frankly with 3 young children I would REFUSE.

    Secondly, you do need to get to the bottom of this problem as it would certainly appear strange that the court threw the matter out and yet the council are stating that you are still to repay ??

    Third point and one that is most important is that the council will first need to obtain Liability Orders against you before the debts can be passed to a bailiff but please be assured that IF this is to happen, the bailiff CANNOT apply multiple charges. What this means is that if he has six accounts, he cannot charge 6 visit fees and 6 levy fees. He can ONLY charge a total of £24.50 for "attending to levy.

    Ensure that any vehicle that you own is NOT in close proximity to your house and this WILL be levied upon.
