I received a debt collecting letter today, it says its for a Capital One debt - its so so long ago since i had a capital one card that i have no idea when this debt is from or why they are contacting me now but i know for a fact that this debt is definitely not on my credit file (experian or equifax) - can they still persue it and should i ignore it or contact them? I now have a capital one credit card as i finally got a clean credit file about 3 months ago.

How long since you last made a payment on this or acknowledged it in writing? Over 6 years?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Send them a 'prove it' letter.
If the debt is over 6 years old without you acknowledging it they are acting illegally by chasing it.
Send the letter and then get back to us.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -

I'm almost certain it will be more than 6 yrs but will dig out my old credit file and reply later, i know i only have one active debt on my credit file now - i'm wondering if they've contacted me either because i've just got a new capital one card or i've recently gone on the electoral roll. I konw it won't be current as i took professional advice years ago and that's how i sorted my file out.A home is not a home ..... without a dog

Ok the letter is from Red Debt Collection Services, says they have been appointed duly authorised collection agent for Lowell Portfolio etc etc.
However I have found my credit file from last year and the account is as follows:
Defaulted, Date updated 20/03/07, start date 01/05/2002, date last delinquent 11/02, default date 27/11/02.
As stated previous this debt is now not on my credit file as asssuming the default has served its 6 years.
Can i send them the letter in the link?A home is not a home ..... without a dog

Assuming that you think you did not acknowledge that debt in writing or make a payment in the last 6 years, then yes.
By the way, Red Collections is a trading name of Lowells. They frequently turn up on these forums chasing statute barred debts.
In fact the phrase "notorious" for it, is not an understatement.:rolleyes:Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

[STRIKE]That default should not be showing on your credit file as of 27/11/08, i am surprised it is still on there, you should contact the 3 credit reference agencies and inform them the default should already have been removed.
I agree, send the statute barred letter.[/STRIKE]Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

That is a report from last year. It has now gone.
