Reclaim brokers fee.

A few months back I came on here asking best place to get a loan. Someone sent me a pm saying they got a loan with credithelpers.co.uk at 8.9 % apr. So I applied. I got a phone call. A woman said that I had been accepted. I was given monthly payment details and total amount payable. At the end she said there was a fee. I paid it then went round reading about the company and found they don’t offer loans. Just a broker. So I wrote to them a letter saying I was misled. And wanted a refund. I never got a reply. So I waited to see it they got me a loan which they did not. I am now asking for a refund minus the £5 brokers fee as in their t&c’s it says,
If We provide You with no services other than acting as a loan or finance broker and You do not effect a loan or debt related solution offered by a lender or finance related company within the 10 weeks We act for You, We will refund the fee less the £5 brokerage fee provided for by the Consumer Credit Act 1974.
Their response is they will only refund me £20 as a good will gesture. The fee was £48.99. Is that all I am entitled to claim?

Looking back at his posts, he appeared to be desperate for a loan too and was making applications all over the place.
It is possible the idiot received the same speel as you and assumed he had his loan at 8.9 and advised you to do the same before he received his bad news of no loan.....
or he was that miffed at getting ripped off, and wanted others to suffer the same fate.
or maybe he DID receive his loan (unlikely as it is).0 -
Hi I am now sitting in this position with a company calling themselves A K Solutions. I paid a finders fee of 38 quid and am having real trouble even getting in touch with them about returning this to my bank acc.I wonder about any of these sites and won't be ever ever ever be making any contact with loan companies again ... I now believe they are all a big scam and only taking advantage of the needy and desperate, like myself. Benefits and bad credit rating,, non home owner, single, skint parent!!!!!!0

I recently applied for a loan with Yes Loans and paid a brokers fee which was not the best thing to do but they stated loan pay back amounts and I needed the money for a wedding.
However nothing happened and I therefore submitted a letter by recorded delivery and fax to them and complained to the Financial Services Ombudsman about them.
I redeived a letter and a full refund from them but have advised that they have not yet fully responded and therefore until they do I will not close the complaint. The Financial Services Ombudsman forwarded to me their letter stating that they had resolved it and therefore asked that they would not have to pay the fee for the FSA!!
Therefore to get money back threaten to use FSA and actually report them!!!!! I did and have my full fee0 -
I have managed to receive broker fee refunds for myself and friends. Send a letter stating under s.155 of the Consumer Credit Act 1974 you are entitled to a refund, minus £5. I stated I expected a cheque within 14 days, failing wich I would issue proceedings without further reference to them.... Seemed to work each time.
If you find yourelf ever having to call a premium rate number to apply for a loan, the same process applies.... Send proof of call costs along with any letter.0 -
I got my money back. I phoned consumer direct who said they had to repay the fee minus £5 by law. So they got someone from west Yorkshire trading standards to phone me. After they sent an e-mail to best4loans, I got a phone call saying the money would be in my account in 3 days.0
