    no, noone heard any of the supposedly threating and verbally abusive conversation I had with him, although people have stated that I was invading his space and talking very close to him...

    Truth is, it was a very loud bar, I had to speak close to be heard, and the whole time he was resting with his elbow on the bar as casual as shorts and flip flops.

    I agree that there is not much mileage in the racism thing, but only because you have no witnesses. If you did have a witness, I would have suggested a further, separate, grievance using the company's equal opportunities procedures.

    Was it racism? Would the OP's wife's nationality have been mentioned if she had been English? Thought not! I wonder whether this is actually at the root of why the OP has been picked on by the bully.

    Going back to a basic question on the events of the night.

    Was the sales manager the most senior member of staff at the function?

    If he was why did he not tell you to leave immediately he made the accusation?

    If he wasn't why did he not report it to the most senior person immediately? And, why did that person not suspend you forthwith and tell you to leave the function?

    These are both important questions that require answers at the Disciplinary hearing. If the matters they accuse you of are serious enough to warrant suspension and possible dismissal the company had a duty of care to you and its other employees to act immediately. If they use the excuse of inebriation for not acting immediately then they do serious damage to their own case at any later Tribunal.

    The Sales manager was not the most senior member of staff there, There was another who holds a slightly higher rank than him, but he was very drunk when he asked me to leave (he's the one who I told to f*** off as he interrupted my conversation with the sales manager when he said I was high on drugs and being abusive)

    So I guess I was told to leave, but I had a point to prove and wasn't going to let them walk all over me that easily.

    If the venue wasn't booked by the employer as a private function, there would be a more tenuous link to the altercation being in "works time" surely?

    No it wasn't, earlier in the evening they hired out a restaurant and paid for meal and drinks only in that place.

    Then many people went home while a few (20 maybe) decided to go into town to a few pubs for a few more drinks... who wouldn't right, with people like this!

    The incident took place at around midnight (maybe a little earlier - can't remember) in a pub where we were paying for our own drinks and were with many other people.
