In my experience unless its nailed on,your wasting your time filling in the forms,when is a "red letter" not a red letter? answer when its typed in black and has the line "there is a high risk blah blah blah" in smaller print on page 3 of the letter,amazingly, i"ve found out today that from 2004 red letters were typed in red ink to indicate there importance,for all us trusting fools who are now "timed out" tough,why should whether any time limit exist? i was mis-sold my policy end of,quote "it"ll pay the mortgage and leave you with a nice bonus" i can see her now ,these are my views ,hope others are successful0

Keep an eye on the press, hopefully (but I wouldn't hold my breath) there may be good news for those time barred by the original red letters. In my court case a judge ruled that the red letter wasn't a red letter i.e the clock didn't start ticking. I know that one of the claimhandling firms, Brunel Franklin has threatnened the FSA/FOS with legal action over time barred complaints (it's in there interest as they could still earn a lot of money from time barred complaints, now their work is drying up) also the Consumers Association are contemplating court action along the same lines. So don't give up hope, it's a long shot but you might still have a chance to have your complaint looked at.

The FSA have already rejected their threats. So, its now down to them to decide on court action or not.I am an Independent Financial Adviser (IFA). I was rejected and went to the FOS, and it was the fact that they were requesting info off the Halifax that made Halifax relook at my case and settle.illegitimi non carborundum0

Hi ,thanks for the reply,i was initially going to let Brunel Franklin handle my case having seen their adverts in the press,but having read the articles on this web site thought i"d give it a go myself,although time consuming i found the process quite easy,now that the ombudsman has refused to help in my case based on the time scales involved can i now use the no win no fee offered my Brunel Franklin to fight my case, my case is as follows
1)Mis-sold in my opinion in 1991
2)annual statements till 1999,no mention what so ever of any risk policy will not reach target
3)request statement in 2003 having not had one since 1999
4) receive 2003 statement in May which on the 3rd page in black ink and smaller print indicates there may be some risk my policy will not reach the target
5)receive a statement in Oct 2004 which is printed in red ink and indicates there is a high risk my policy will not reach target
6)Contacted ombudsman after having no joy with countrywide assured due to being time barred,this based on a projection that they insist was sent to me in 2000,after requesting said projection it has now appeared 6mnths after the first request via the ombudsman
7)ombudsman sides with countrywide asssured based on the never recieved projection of 2000,the red letter that is actually in black ink of 2003,
any advise would be much appreciated,many thanks in advance0 -
