No fee required.
As said, if it is statute barred then there is nothing Wescot can do. They would be obliged to cease trying to collect the debt.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thank you. Another quick question - sorry. If I send the statute barred letter (which i've now decided to do instead), am I to assume that Wescot should send me details such as amounts and dates of payments or correspondence with their reply if indeed they do dispute the time period?
Also, how long do I wait before I contact following my letter being sent? I've read that when it's regarding credit agreements there's a 14 day turnaroung for them to get a copy and forward it to the debtor - would it be the same for a bank?
Sorry to be a pain but I'm very aware that xmas is coming and some companies will claim they sent them but were delayed by the post etc or discount the holiday period if it suits them.0 -
How fast or slow they work is their problem, not yours. They are trying to get money from you without carrying out any checks etc.....dont make any allowances for them, if you are correct with your timings and you stay within the Law then they dont have a Claim.
If they keep hassling you, then make a Complaint and claim for compensation. we can help you there as well.
Please send any letters by Recorded Delivery, dont use a Signature ( or put a line through yours), never talk to them on the phone, dont give them ANY information such as phone number or employers etc and keep copies of everything.
:D stay wonky

Oh yeah, I forgot about the signature - obvious really with copy & paste etc. Phew thanks!!
I'll head out to send by recorded delivery today. Is that possible to a post box address?0 -

Yes OK with a PO Box. You rarely get a signature for these things as they re bulk delivered by the PO as they have so many. Barclaycard get over 2000 requests a week......to which I kindly replied 'not my problem:D'
When you go online to check using the number on the Postal receipt you will simply get a 'delivered on' or 'out for delivery on' date. Therefore you can assume that service has been made on that date.

Just called my local post office. The very kind lady there said it is possible but preferable to a more complete address.
I have: PO Box 137, Hull, Hu2 8HF
Can anyone improve on this please?
Thanks again0 -

following on from this..... I sent the above letter and have had a reply a couple of dates which I alledgedly made payment on. They conveniently fall within the aforementioned 6 year period.
However they are only dates typed by them onto the letter and include no copies of said payments or any details such as which form the payment was in (cheque, cash etc) or where. So basically they are claiming this with no proof.
Is this a point where I re-send the statute barred letter but highlight the provide evidence paragraph/sentence or is it beat to send the NDL 'prove it' version?
Thanks0 -
I think I'll send the statute barred letter again but further highlight that written evidence is to be provided. They claim a payment was made to Yorkshire Bank directly and then one to themselves about a year later but both within the 6 year period.
I take it I'm right in thinking a letter from them simply stating this isn't sufficient?0
