I cancelled my DD with the bank last month because I couldn't afford it etc and without my consent, not only have they reset the direct debit up without my knowledge but they've taken payment from my bank account.

is there anything I can do? I'm absolutely raging :mad::mad:

Exercise your direct debit guarantee and have it returned. Pop in to see your bank manager, explain that you cancelled the DD and they have set up an unauthorised one. They will return it immidiatly hopefully.

If you have telephone banking set up you may be able to.

Try it, they can either sort it, or say sorry you either have to go into branch, or write a letter, but until you try you wont know.

I expect they were raging when you decided not to meet the terms you agreed when you took the loan out.

Did you ring them and discuss it first??

I thought there were issues with DD where the customer couldn't cancel them, only the company it has been set up to pay.

The customer can cancel a DD whenever they wish, it is between the company that the DD is set up with and the customer after that.

As well as what the others have said, you should also make a formal complaint to their head office.
  • How soon before the payment was due did you cancel the Direct Debit?
Direct Debits need to be called by the company at least 4 working days prior to the payment date so if you cancelled the DD within this period then the cogs would've already been turning.

Whilst I don't think Welcome would have any right to setup a Direct Debit, you have no right to not meet loan repayments. Depending on your agreement with Welcome, they have the right to chase any money you owe them.

I expect they'd be something in your agreement with Welcome that gives them the right to take money that you owe them.
