restored hearing

my lender had a court hearing in may 09 which i managed to get adjourned and keep to regular payments, in october my maternity allowance ended and i was looking for wrok, i advised them in october i had found a job and was starting first week in november (was for local council so needed refs and crbs etc) i then found that i was going to miss the nov payrun as we are paid on the 22nd each month

advised them that i would be able to pay dec 22nd and would be double (dec and jan) they said i coiuldnt do this and they would restore my court hearing...

which they have for first week in jan...

i rang them yesterday and explained again what was happening, the woman was so rude to me and just kept telling me how much my arrears where...

i explained that i can pay 2.5 times my payment next week and then £250 per month on top of normal payment to clear the arrears.. she did income and expenditure and agreed that £250 was what i could afford...

but she had to put it to her manager first.... my local council have advised me to find out what i need to prevent the court case (get it adjourned again) as they may be able to help me via their mortgage rescue scheme...

no one called me back (i called yesterday 9am and the lady knew i was seeing cab again today and had my council meeting) she said she would call me back in a few hours

now the guy i just spoke to says it takes 48 hours! he tried to get through to the guy dealing with it but he was away from his desk...

im also being told that it is unlikely they will adjourn the hearing unless i pay full arrears...


he mentioned something about getting the arrangement set by court rather than going for possesion... does anyone know anything about this?

im so confused... im putting all my wages into this payment next week and im terrified that we will lose our home and have no money to secure reted accomadation...

any advice would be much appreciated

includes: £10k mortgage arrears, £4k credit cards £4k loan, £15k 2 cars HP. £2K store cards, utilities, family!
Trying to get car HP sorted should be total £8k

    I can't offer any help other than to consider contacting Shelter. They have considerable expertise, help and advice. Their English website is http://england.shelter.org.uk/ They in partnership with CAB and others can help avoid a repossession.

    Having it "set" by the court in effect means a suspended repossession order where the judge signs off on a reasonable payment schedule, which if you do not keep to means the lender can effectively fasttrack repossession proceedings.
