i was left by my first husband in 2002 after i had got credit in my name for him to clear his 'debts' which i now doubt actually existed - to the tune of almost 44k
i have been paying these off and he was paying me maintenance for our 3 children plus some to pay towards the debts he left me with - in september this year he emigrated - gone without a trace - no one can find him - and yes he has stopped paying me.
i now cannot afford the debts i have and it looks as though bankruptcy is my only answer i have -50 a month to live on!
i took out an overdraft online with cahoot in 2001 for 8000 handed my ex the money - i have been paying 80 per month since then and at first they were charging me 20 per month for the overdraft they are now charging me 68 per month - at this time i owe 7944 on that account as at times when i have been short of money i have not paid the 80 - this then takes me 6 months to get back to where i was when only 12 a month is coming off of the debt - to date i have paid them 7120 can this overdraft be covered under the unenforceable debt as i applied on line and as far as i can remember never signed anything???
any advice greatly appreciated x
