Bought mobile (unsealed) but its marked

I bought a mobile and they bring it out unsealed. From reading on here it appears to be the company policy.. but the phone box says do not accept unless sealed :S
Anyway.. it was on offer a couple of weeks ago so I bought it as a present and then waited a couple of weeks to give it to her..the pink E530.
The phone comes out (on her birthday) and the back (the battery bit) had no plastic packaging and has lots of little marks. The side of the phone also has a tiny mark on it.
Im assuming that Argos will refuse to take it back because they wont let you take phones back. However, my girlfriend was less than impressed that I got a phone that was unsealed, and even less so that it looked like it had been lying around somewhere.
Any ideas please as to what I can do?

Didnt they go through the contents in front of you, they do at mine. Have you registered and used the phone, if not l would take it back and explain what has happened without using it so you can at least prove that you havent been using it. Did they give any explaination as to why the phone was open !!!! seems very fishy.0

No, they didnt explain why it was open. It was just put in the bag. I have put a SIM in it and it works, but I havent actually used the phone. The PAYG sim is still sealed, as is all the contents inside (carry case, headphones, instructions etc)Be nice0

I think that the exception for mobile phones only applies to their 16-day "no-quibble" policy. In other words, you can't return it just because you have changed your mind, like you can with most other products.
However, in this case, that policy is irrelevant. It's a damaged item. They should accept the return and give you a refund or replacement.0 -

"What if there's a problem with the product?
Within 30 days
Please return the faulty product(s) with the receipt and we'll usually offer you a replacement, repair or refund."
So, if it's less than 30 days since the purchase, you should be OK.0 -

I have left it up till now because I didnt thiink they would do anything about it. I know that my store has none in stock but a nearby 1 does. I guess I will go to mine 1st, and if they refuse to give a refund then I will have to go to the other store.
