Bonus Query/Problem - Advice Needed

I leave my current employer next Friday (18th Dec). The employer has just informed the group that all staff will be recieving a bonus in reflection of everyone's work over the last fiscal year (October 1 - September 30). The bonus is £100 and also 3 days annual leave that can be taken either this year or carried into 2010.

I have just been informed by H.R that I will be getting the £100 and not the 3 days leave. This sounds wrong to me as I have contributed over the whole of the qualifying period that the bonus applies to. I have been here 19 months. I would expect the 3 days leave before I leave or the cash equivalent.

What do you guy's think?

Do I have any reasonable recourse to deal with this situation?

    Is the bonus scheme contractual or discretionary?

    If it's contractual, you possibly have a case (depending on the terms of the contract).

    If it's discretionary I think you are quite lucky that they are giving you any element of it.

    The bonus scheme is contractual. The £100 plus 3 days is what they have determined is the bonus award this year.

    I think you'd possibly find that technically, if you're working notice, you're not entitled to anything. I could be wrong, I often am - but i'm sure someone who knows for sure will correct me if i'm wrong.

  • Have they given you a reason for not giving you the full bonus?

    This is a response I got from H.R

    "As you will be aware the annual leave element of this years bonus is not a normal element of the bonus scheme. The decision has therefore been taken that anyone who is leaving, will still receive the payment but will not receive the leave."


    The first email we got off the CEO of the company stated that everyone was getting the £100 + 3 days off and now H.R are saying everyone except people that are leaving. There is nothing in our bonus guidance that covers this situation.
