Really worried about car...

Hi All,

Hubby and I are really worried about our car situation. We are going BR next week.

Our circumstances are that I am expecting our fourth baby which, when born, will give us a total of 4 children under 4. I am also disabled and have a blue badge. My husband cares for me and our children. I need a car to get around generally and would be stuck in the house without it. Our car is worth £4000 and I have just been advised by CAB that there are no guarantees that we will be allowed to keep it. Previous advice had been that there shouldn't be any issue with us keeping the car so now we are really worried. Not that we have any other choice than BR but life without a car will be hell for me & wherever I am, my husband and so obviously my children, have to be so life will be hell for all of us :(

  • With you getting DLA for your disability, would there be any way you could have a Mobility car? This is something we would have to look into, if our car is taken away from us.
Would there be no-one to help you buy your car back from the OR if allowed? I believe dependant on circumstances the OR will allow upto £2000 for a car allowance. Sorry can't be of more help, I'm sure there'll be someone more experienced along soon :)
Best of luck with the BR next week :)

it comes down to the OR, there is no definitive answer on cars. you will need to tell the OR your reasons for needing the car, being registered disabled and needing it to get about etc. if need be you can back it up with a doctors note
    good luck

The £2,000 is not set in stone, the actual rule is that it depends on the needs of the person and is at the discretion of the OR
Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.
  • Hi, does your husband have a carers allowance (this is the same as needing the car for work)? Are you sure the car is worth as much as £4,000? And is there something about the car that you need because of your disability that would mean a cheaper one wouldn't be any good?
  • My husband is eligable for a carers allowance as I am eligable for middle rate care on DLA but the application for both is only just being processed. It was only when we sought help from CAB that we realised we should be getting this. I have high rate mobility already but the term left at the moment isn't long enough to qualify for a mobility car and to be honest money is so tight that my DLA is mostly consumed into my living expenses in my SOA although we are trying to get rehoused to reduce living expenses.

The only issues I have with the car are that it needs to be relatively high, otherwise I struggle to get in and out of it. Also, like I said, my husband has to come everywhere with me and so, therefore, do our children. As they are all under 4 they are all still in bulky car seats so the car has to be able to accommodate these.

I have some copies of medical letters that have been sent to the council in respect of our rehousing application so I guess I could copy these to the OR as sort of supporting documents.

    Indeed. :)

For example, foxy here was allowed to keep one worth £3.5-4K due to circumstances.
If I were you, I would give the Insolvency Service an anonymous ring and chat it through, they are very helpful.
When we spoke to the OR she required as much info as possible to try to keep the cars. OH's was straightforward, we live in the sticks, rubbish public transport etc. His was allowed. Mine is worth £3500-£4000, and was purchased last year. It is an MPV. I have 5 kids, the eldest receives DLA, he has Aspergers. I had to list how frequently his hosp/doc appointments were and the fact that I have to drive to school etc, need car for food shopping, also baby has reflux disorder and hosp appointments etc. And I was allowed to keep it too!!!

Obviously, nothing is ever guaranteed, but if kutiez2005 puts across the case for needing that vehicle, then there is a fair chance.

  • Really hope you get to keep your car. Our son gets high rate Mobility, but like yourself, the money that he gets help us out with our living expenses, if we are short some months, so I know where your coming from there, and to me that's a reasonable reason not to go for the mobility car :) Best of luck for next week. x
  • Do you think I should add some notes to my court papers to express my need for a car or wait until I meet with the OR?
  • Nothing to stop you...although its the OR in the end who would decide on your car not the court

We are in the same position except we are already BR and have had our first OR interview. I need a high car due to a back problem and have explained this to the OR. She told us to send in a copy of my blue badge and also to get as much supporting material as possible. I have just sent in a Dr`s letter highlighting the need for independent transport and a copy of my blue badge, I will update on here as soon as I hear anything.
