Did you tell him its not your address its your mums and everything in it belongs to her?
He cannot and should not take anything that doesn't belong to you, however Baliffs can and do lie to parents to try to bully them into paying up.
Is there anyway you could take some time off and go to the council in person? Or ensure you finish early so the call can be definately made to the council.
Also have you told your mum? She needs to know the situation so she isn't wrong footed if the baliff turns up when she is out.
It sounds like you have very little they can levy on, but they will look for electrical goods you own and cars in particular.
The other poster is right you never let them in, once they are in they and have had "peaceful entry" they can legally come back in any time(although their code of conduct states they should make all efforts to avoid entering a property when the debtor is not there, some are less bothered about the law and fair conduct than others).

Please also check out the baliff forums over on the consumer action group as some very knowledgeble guys over there. You want to get a breakdown of the baliffs charges as they have VERY strict rules about what they can charge for council tax collection, but will lie to try to apply higher amounts.

If I remember correctly it is around £25 per visit ONLY and a max of 2 visits can be charged for. They can add extra charges if they have to come out and actually take goods.

I have seen people who even at your stage have gotten the council to take the account back, and basically they told the baliffs to whistle for their charges, and none ever sue.

  • £42.50 max they can charge for visits (split over first 2 visits) then all others are free (who said no such thing), but you'll find then the "attendance with van" fees coming... £100+

You need to get your mum to sign a statuary declaration saying that all the furniture etc in the house is hers, get it witnessed by a solicitor (£5) and then keep it to hand to show the bailiff if/when he comes back. There's a template on here somewhere but I'm rubbish at finding them!
Unless I say otherwise 'you' means the general you not you specifically.
  • thanks for the advice.

ill be ringing the council tomorrow morning so ill post the outcome on here.
