Help! Where do I stand? Rec'd parking tickets from NPC & Local Council

  • I still can't see how she owes the scum anything, even the council ticket is very debateable on De Minimis. She needs to sort out EXACTLY where she was parked and EXACTLY who owns what bit of land. Solve this and maybe noone is paid, leave it and its a lot of mazuma.

    The one from the scammers - hmmmm. You should both have IGNORED that one.

    But now that the driver has spoken to the BPA about it then I wouldn't put it past them to try to use this case to try to score points (i.e. encourage NPC to take her to Court, since they know she's the driver and have photos and presumably some signs in situ?). Presumably hasn't been silly enough to tell them she was driving and gave them her address, phone number, shoe size, PIN number et al? Pleeeeeease tell me she didn't?

    That would certainly target her, and if she is sent any correspondence about the charge, IMHO she may be better to then send the 'put up or shut up' reply to NPC (not to the BPA!). Not mentioning who was driving in a letter of course, and only doing this IF she is contacted directly. If not then you and she should both ignore it now.

    But if (ONLY IF) she is contacted, then maybe reply with something general along the lines of 'I dispute/deny any debt to your company and will not enter into any further correspondence in this matter outside of County Court proceedings. If you do not advise me within 10 days that you have instigated actual Court Proceedings in the County Court (with case number) then I will consider any further correspondence from you or your agents as harassment.'

    As for you, as you are only the registered keeper this debt is not yours, you certainly should NOT acknowledge it. This is just getting silly now! :confused: Keep all your correspondence though and don't take your eye off the REAL ball (the COUNCIL ticket deadlines!!).

    Anyone else beginning to think this thread COULD BE a set-up with a view to fabricating a 'patsy' case where 'advice has been given' by this forum and by pepipoo?

    If this is simply a set-up case then I'd like to make it clear now that EVERYONE ADVISED YOU/HER TO IGNORE the fake fine. I cannot understand why on earth anyone would phone the BPA, they don't act for motorists - indeed they are the most biased 'agency' anyone could think of to phone!

    If this is genuine then yes, she has screwed this up TBH, and sorry for my cynicism.

  • It is difficult not to be paranoid about things like this, I wouldn't put it past them to try to stir things up like this. But, if it is genuine, I still think the PPC can be ignored from this moment on, despite the phone call.

    The phone call will not be too usable, however it could be problematic.
  • Thanks for the advise (and the cynism!) which we are very grateful for. My daugther tried to sort the parking tickets out herself, not wanting to tell me that she'd received them (and when you look at the photo below you will see why). She didn't realise that the car was registered to me and any correspondence would be received by me. When I made my first thread I hadn't realised that contact had been made with various people, so sorry if I've misled anyone and I am getting more and more confused as the days' go on.

    After speaking to my daughter last night, not only did she speak to BPA on the phone she offered up her email address and had emailed The City Council too! Please see response to emails below and a link to a photo of her car.

    EMAIL RECEIVED FROM BPA.

    "Dear (Name Removed)

    Following up our telephone conversation of yesterday please find attached the photograph from National Parking Control and the contents of the email response I have received.
    "After speaking to you earlier on today, I spoke to the attendant who had issued this PCN and retrieved the following information. It is clear that the driver of the vehicle parked on our clients land (on the pavement) without a parking permit, even though a warning sign can clearly be seen directly infront of his vehicle, thus as far as we are concerned this contravention did occur. However around the same time the attendant encountered a civil enforcement officer from the council approach the vehicle with the intention of issuing a parking ticket. Our attendant explained that this vehicle was parked on private land and a PCN had already been issued, however the C.E.O stated that the reason she will also be issuing a PCN is because the vehicle was parked inbetween 2 sets of double yellow lines (seemingly ignoring the fact that it was parked on private property). I dont have any doubts regarding the validity of the PCN issued by our attendant however to my knowledge the councils CEO should not have issued this PCN."

    Looks like they both want their money, but at least the City Counsel are willing to investigate.

    Still can't see how this photo proves its private lane. I'd have assumed the notice applied inside the building not on the road. D/yls on private lane are just painted lines and have no legal standing anyway.
    Give the council a short while and follow up. Its important to find out who the land really belongs to so you can see who to pay and who to ignore.

    Yes, of course the private parking company want their money. :rolleyes:

    So does the Company which has written to my family this year about a ticket for parking on private land. We've ignored them of course. :p

    So do all the PPCs who write to people threatening Court and Debt Collectors, etc. Those motorists then either become a victim and pay, or come on forums like MSE or pepipoo.com and get advice, which explains that this fine is NOT enforceable in law. Have you read some other threads here from all the others who we've advised NOT to pay any private parking ticket?

    Really hope you are not going to make yourself a victim by paying the scam company, NPC. IMHO, anyone who pays is frankly a mug and helps the PPC's scam to continue...

    Finally, re the Council ticket, if the Council reject your/her informal appeal then don't rush to pay it before getting advice from the experts on pepipoo. I'm only new to this forum board but personally I fail to see how a car can possibly be both on 'private land' and 'highway' at the same time. Did you know that most 'proper' (Council) parking tickets asked about on pepipoo are able to be successfully challenged and the poster doesn't have to pay?

    Sorry to be a cynic before - couldn't believe anyone would involve the BPA!

  • After discussing the location with my daughter, she has said that there is an area for bins on the righthand side (drivers side). On the left is the road to the entrance of a car park to where she resides. It is more than likely therefore that these areas are both private and both sets of yellow lines are on private land. The actual road (blast lane) is behind the car and the car is not sticking out onto blast lane at all. Do you think that I should send the response received by BPA to Sheffield Council or just wait for their response? Many thanks again.
