Is there anything we can do?

My other half lives in a shared house with 3 other people.
The gas and electric is in his name. One of his house mates has now stopped the standing order into his account and keeps swerving him so he doesn't have to pay.
My other half is on Job seekers so can afford to pay for 2 peoples worth of Gas and electric + rent etc. Yesterday His house mate attacked him and threatened to kill him if he asked for the money again. Stamping on his neck. He cut his hand in the struggle. He said there was no way he was going to pay the money and he was going to take off so he didn't have to pay. He is too scared to try and get the money from him but he also on the other hand cant afford to pay the bills. The landlord is aware.
My other half has now encored CCJs which is going to ruin his credit rating (what if we want to buy a house together??!?!)
Do you think it is worth him taking this to court? Maybe he could declare bankruptcy? will he be able to get the money back from him and if he does will he still get a bad credit rating?
Help would be much appreciated

Call the police have the guy arrested .
  • Your other half was unwise to have the gas and electric is his name, but what's done is done at this point.

The first step is to address the violence from the house-mate. Has your other half been to the Police and reported this incident? I confess this is not my area, but I don't think he should continue to live with someone who is being violent and threatening to kill him, so perhaps there is some possibility of getting this guy kicked out for breach of contract or something (presuming there was a contract signed and there is a clause about allowable behaviour, of course). Failing that, there may be some legal option, but unless this is reported to the Police, there is no chance on that front.
Lightbulb moment March 2004 (Debt £55,000) & debt-free as of May 2007 (thanks to CCCS, and a remortgage to clear last £20,000).
    Looking to the future!
  • Get him out of the house... asap. go to hospital and get evidence of the assault at the same time contact police. totally unaceptable.

That sounds awful - the money seems almost secondary - he really needs to get the guy out of the house and get himself out of the house - nobody should have to live in fear like that.

  • i agree with the other posters, get him out and then sort out the money, it is far less important than his safety

  • You MUST call the police and get them involved at this point, firstly for his safety. I've heard stories from people at work who had bad/dangerous flatmates so this must be done first.

Secondly evidence provided and recorded by the police could then be used to have a CCJ set aside as the reasons for failing to pay was because of the above. The debt was not his fault and it was criminal behaviour by others that forced this to happen.

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies
