Default removal help please

Hi, new to the forum and have a nightmare that I'd like some help with please.

I applied for a couple of bank accounts recently and was declined, even with credit scores of 921 with experian.

Spoke to experian who linked my file with my old address, even though they had it on file and a defaul notice via Aktiv Kapital was applied to it.

The default relates to an overdraft I had with HSBC some 2 1/2 years ago and I paid the amount in full to Atkiv Kapital. Naively being told that because the debt was settled that my credit score would not be affected. As of today it's now gone down to 699 and is in the Poor category.

Experian advised me that the only people that are able to get the Default removed are Aktiv Kapital.

First phone call with them ended up with the call handler being aggressive and offensive over the phone. Called them back and spoke to their complaints department.

They say that they're now going to apply for the relevant documentation from HSBC regarding the account that I defaulted on.

Is there any way of getting the default removed, or am I screwed until 2013.

    Did you default on it? I would assume so if it was passed to Aktiv?

    If so, when?

    Did you originally get it in writing from Aktiv that defaults would be removed if you settled the account?

    Yes I'd defaulted on the account, which was an overdraft facility provided by HSBC. The default on my file says 9/1/07 and updated on 3/08/08.

    I didn't recieve anything in writing from Aktiv that the defaults would be removed as I dealt with it on the phone. I was a little naive as it was the first time I'd had to deal with this kind of situation.

    Apart from maybe getting that corrected if it is way too recent a date, I can't really see grounds for having it removed.

    You did default, so that being recorded on your credit reference files is regarded as 'fair'.

    I can't remember when the account was defaulted on. I guess I'd have to contact the bank for this information?

    The date seems a little strange though as it was the date before my 30th birthday and I'd have been sure to remember a letter about something so serious then.

    Was a difficult time when it all happened, major surgery in hospital, relationship breakdown. Not an excuse for defaulting I know but my head was well and truly in the sand at that point. I'm just annoyed in the fact that when I did address the issue that I've ended up now getting screwed until 2013 even though I'd had assurances that this wouldn't happen.

    It's a major setback for my credit rating. Over the last year and a half I've reduced my debts to 19k from around 50k and was feeling good about seeing the light at the end of the tunnel.

    Now I feel really down and gutted.

    Did you manage to get this removed?

    If not ask your MP to help get the law changed. 6 years is too long a punishment, considering that the debt is satisfied.

    Meanwhile, if you're needing cheaper credit, try a small claim against Aktiv to have it removed. Extra interest over the next 3 years could add up.
