Terrible arrears but want to know if I can claim back my charges

There has been some suggestion (which was confirmed by Wonder Girl ) that creditors can get very nasty if you try to claim charges back while on a DMP. Even those without financial difficulties have encountered problems with banks closing accounts without warning, cancelling direct debits etc.
If you are on a DMP then a couple of things could happen . Firstly they can tear up the agreement and put you back on the dialler. All the calls and letters will start up again. They may then skip the debt collection agency option and start legal proceedings for the full amount owing.
It's true that if it comes to court you could then argue your case and hopefully get the judge to agree to an equivalent amount to the DMP but it is a bit of a gamble. Not to mention a lot of extra stress.
If you have started to sue your creditors BEFORE they try to sue you I believe they have to wait for the outcome before being allowed to take legal action against you as the account will be in dispute . That doesn't of course mean they can't keep phoning and writing.
So I guess it depends on whether you're feeling lucky and how helpful your creditors have been so far. You may not have any problems. Some banks and credit cards have rolled over without a fight. Others go right up to court .Then again it could be a right nightmare. Personally I'd love to take on Natwest as they've refused to freeze my interest but they've been so difficult in the past I'm really not sure I can handle any more of their unpleasantness!

Why not claim from each individually and then use the money to pay off the next before claiming from them?
i.e. you claim from your bank and use some to pay off your overdraft and then pay off credit card A. You then claim from CC A and use this money to pay off CC B etc. That's what I'm planning to do![strike]-£20,000[/strike] 0!0 -

That would only work if you are able to service those debts without the charges being refunded as the process takes quite a few weeks at best.Leason learnt :beer:0
