Going for it but totally lost! Please help :(

OH and I are off to the court tomorrow to start proceedings, but I have no idea what I'm doing, what I need to take etc. I''ve read all the literature from the court and have been on the phone to them a dozen times this week with questions, but there are still a few bits I'm not clear on. If anyone can answer any of the below questions tonight, I would be very grateful!

I have my two forms done and printed(6.27 and 6.28), do I need more than one copy?
What do I need evidence of? I don't have statements from all my creditors but the court said that didnt matter when I called. Do I need payslips, bank statments etc and if so how many?
Do I need to take anything in relation to the car (insurance, log book etc)?
Is my OH allowed in with me (it's me that's going br)?

Also I have no idea what's going to happen to the bank account! We have a basic joint account from Yorkshire bank (although it does have a maestro card, it is still a basic account). Does anyone know what they are like with br's? We don't owe them any money and I don't think they're linked to any that we do (that's why we chose it) but who knows these days?!! Also both our wages go into that account, so do they make some allowances for that when freezing the account for things like food, travel to work and rent?

Do I have to tell people like brittish gas and my insurance company, or just when I renew?
Same question for work and potential employers? I'm aware of the restrictions on being a director etc. but I'm on a waiting list for a position with the dwp and they are checking references for another job with them also, as I wasn't br at the time I didn't put it on the form (they did ask), should I call and tell them or wait until I work there?!

Unless you have got your OR interview straight away afterwards then you will not need any of this info, this type of info the OR will ask for.

You would be best advised to open a co-op or barclays basic account as these are the only 2 BR friendly accounts.

    Did you seek advice from 1 of the dect charities ? as the judge may ask you this and if you haven't they can refuse you BR until you have.

    I dont know all the answers you have asked here but will answer the one i do know.

    For court you only need your paperwork 6.27 and 6.28, my court wanted 3 copies and i believe most courts do, you could phone to check.

    And then just your fees, if you are on benefits you need the approriate form filled in as well as a letter from the DWP stating what benefit it is and amounts and this must be dated no later than 1 month prior to your bankrupcy.

    This is literally all you need to take on the day.

    The OR will require the other info you have at a later date.

    Hi Vicky, i cant help with all your questions but someone else will be able to help, however i know that the only paperwork we took to court were the forms we filled in we didnt need to take statements of anything, the OR will ask for what he wants when you talk to him.

    If you ask when you get to the court if your husband can stay with you throughout the process they may let him but i dont know for sure.

    Your bank account wont be frozen by the OR, the banks are the ones who do that, so long as the OR has no interest in it then the decision is completley down to the bank, we went in just before going to court to let them know but they couldnt tell us what the decision would be untill they had heard officially from the OR, we are with the NatWest. If the bank do freeze the account you have to be able to withdraw your money to live on so dont worry. there are also accounts available now for BR.

    You dont have to tell anyone unless it directly breaks the rules of your BR, we have not told utility companies, car insurance or house insurance, we have changed or renewed all of them since being BR. Im not sure about work, my hubby told his boss but BR doesnt affect most jobs so again if you are not working against the rules of BR then you shouldnt have to tell them at all.

    Hi Vicky, Some good advice so far, there will be some of the real experts along soon.

    When you go to court you will need your forms, some courts ask for id. I took a passport. All other information and details will be asked for by the receiver.

    ref bank account go to coop or barclays and open a basic account and make sure your wages or benefits or wages are paid in to your new account.

    I also agree unless you have arears with insurance, british gas etc, should not be a problem.

    i have also read on here that you should inform car insurers as if you need to claim and you haven't told them it could void the policy - ludicrous i know

  • Yorkshire bank will close your account, they did with ours. They actually told us they dont accept bankrupts cause we are scum.. ok maybe not those words but thats how they made us feel :-(

    As soon as you come out of court open up a co-op or barclays account.

    Hi, i did check very carefully whilst filling out the application and at no point was BR mentioned, this was done within days so i was being very careful and the car insurance is with the same company and we just renewed it, hopefully all will be well

  • Thanks all for your advice, it all went ahead on Monday and was no where near as bad as I was expecting! Managed to avoid any panic attacks in court too, which is a big step for me! Yorkshire are fine with us keeping the account as the OR has no interest in it...sorry to hear that wasn't the case with you nervousmother. OR interview is on Wednesday, got the paperwork when I got home on Friday, and they want 12 months of statements which we don't have so I'm trying to get from the companies but I might have to put the interview off as they might not arrive by Wednesday :-( On the whole though, no problems so far, just hope they don't take the car!

    On the plus I've had three of the best nights sleep in over a year since wednesday!!!
