non payment of secured loan..

Can anyone help…

My husband and I have a secured loan with Direct Line.

We are currently experiencing severe financial difficulty but have always managed to make the payments on the loan although we changed banks from the direct debit coming from my account to my husbands bank and they are supposed to collect it on the 30th of each month.

However… they have failed to collect it for 2 months running now, last month I called and checked all details were correct but as it was 2nd of the following month before we had realised and we didn’t have enough left in funds to make the payment so they basically said not to worry and would start as of 30th November.. but yet again, they have failed to present it. Its not even listed in my direct debits list.

They said after I spoke to them the time before that it was refused but that was not possible and also I would have reference to than in my account .. i.e. a charge, a reference to it going out and back in again but NOTHING.

I am yet to contact them in regards to their failed payment for last month but I feel nervous and upset and am worried at what action they might take.

Has anyone ever experienced anything like this or can give me some advice on what to say when they do call??!!!!!

  • Hi It seems like its their fault. However it could be part of their plan to get their hands on your property.This happened to me. I would not speak to them on the phone they lie threaten and confuse you all part of their tactics to get your property.
    I would first send off for the CCA request - This costs £1.00 send a PO and recorded delivery. They then have 12+2 working days to get this back to you. What they should return is the original agreement which you signed not an application form or statements.
    Then if they don't play ball you can put the account in dispute, don't pay until they provide the right document. If its an old account they may not have it!
    Do not send them an Income and expenditure list. Only a court can have these details. Otherwise you would be giving them ammunition to use against you.
    They also have no right to call on you. Only a postman can under royal charter. The law of trespass would apply.
