Forgot to Clock off last month and lost a days Pay.

Hi Guys
I really need advice as what to do as I clocked on on the 10th of Nov and forgot to clock off. I work Regular 12 hour nights and my start and finish times never varie. I got my payslip tonight for last month and a little note saying I would not get paid for the whole 12 hours I worked as I clocked on but not off the best joke is that there is only me working theese hours and we have full 24 hours recorded cvc. Is this legal to stop my pay if it is not legal what steps should I take to get the money I have worked for and not got. I do hope someone knows the answer with Chistmas zooming up.

    It makes no difference does it? They aren't paying you for hours worked. I'm sure you can prove you were there?

    Well, if it says something along the lines of 'our pay system is run from the clock in and out cards, so don't forget to clock in or out or you might not get paid...if that happens do x, y, or z' then yes it does!

    If you work on the 'clock' system then yes they can withold pay as you did not clock out,however,if there is cctv available you could ask them to have a look and re-think about the pay

    Just had a thought, do you have a 'security pass that you have to swipe/,if so you can get them to check that

    just go and politely tell then u were there on the day,plus if u got any prove of work with time etc on it show it.u must understand that they dont know what time u left as u may have worked half shift on the day

    More information is needed in order to answer your question

    You say that you got a note with your payslip saying you would not get paid for the full 12 hours - how did they know that you worked the 12 hours if you hadn't clocked off?

    Also, it seems that they are not actually saying that you won't get paid for your shift, but that you won't get the full amount - do you know how much is going to be deducted and what they have based that on?

    What are your contracted hours? Were some of the twelve hours classed as over-time?

    What does your contract/employment handbook/disciplinary procedures say about failing to clock on/off?

    Is there any possibility that they might be thinking that the reason you failed to clock off is because you might have left before the end of your shift, and is there any evidence (has anyone actually checked the cctv?) to show that you did in fact stay until the end of your shift?

    Your best bet is to talk to ACAS (phone number in book/internet). It is possible that this is an unlawful deduction, but it is equally possible that this may end up being a disciplinary matter - without knowing your t&cs and the full circumstances, it is impossible to say, but ACAS will be able to discuss the full facts with you and give you information relevant to your situation.
