Data Protection

Quick question

Are the CSA allowed to hold my wifes details including her bank account detailswage details employers name payroll number the lot .They received this from CTC people .

My wife has refuced to give them her details and she is away to get legal advice on this .

Just found this out from my DP files .:mad:

    The NRPP is not legally obliged to give her details to the CSA.

    But the agency has a full record from the CTC people including her bank account details which she is most concerned about .

    She shouldn't

    It came from the Child Tax people as our son was a baby then and she was entitled to the CTC at the time

    Yes it would have come from tax credits, but as part of your joint claim for tax credits (ie the fact that you are part of that claim enables them to obtain information).

    The csa will not have used your wifes personal details to make any calculations - refusal to supply would simply have resulted in no protected income being calculated for you (assuming you are csa1).

    Yes Lizzie CSA1 My wife is fuming as they keep hounding me to supply her details .My wife doesn't want her details passed to them .

    Sifting through my tree mountain they have my wifes full details employer employee number pay details deductions the lot against my case papers .What rights has she got to remove them from my file .

    She should write to them, clearly detailing what she wants. Put it in plain english so that a 5 year old would be able to understand.
    She should also tell them that she wants a written reply.

    I never ask them anything..I tell them what I want, politely of course.

    Want a laugh as well they keep hounding me for my wifes details yet they are there in front of them .I was quoted a few months ago by an employee it is the legislation and the law to give them my wifes details

    Ha Ha Ha he was told politely NO and to take me to court if i didn't give them.He declined to tell me his name :p

    My understanding of the Data Protection Act is that data obtained for one purpose cannot subsequently be used for another purpose within an organisation. I.E your wife claimed tax credits via HMRC therefore just because the CSA are also under the HMRC umbrella they cannot use the same data.

    Have a look at the second regulation in the Data Protection Act http://www.opsi.gov.uk/Acts/Acts1998/ukpga_19980029_en_9#sch1

    I am no expert on the Data Protection act and fear there is probably some get out of jail free exemption with CSA legislation though so don't hold your breath.
