I came home today from work to find a letter from CapQuest demanding money regarding an alleged debt from Abbey for £273.14.
I have not held an account with Abbey since I split from my ex-husband back in 1991 - if the account was overdrawn at that time (and I can't remember that far back) then I never heard a thing from them - until today!!!! Now, I am aware that it is statute barred, but surely they can't seriously be thinking that after 18 years that I would just pay up?
I am right in assuming that as they have not acknowledge me since 1991 and I have not them, that there is nothing they can do now? They can't now put on anything to my credit record can they? Just checking!
I rang the number given to say that I don't acknowledge any debt, but they wouldn't speak to me because I refused to confirm the details on there - I have never heard of them and was concerned it was a scam to get info from me. The name on the account is my old married name (I have been married to somebody else for the past 13 years) which is why alarm bells started ringing. The same day, I got a letter from Abbey saying they have sold my debt - but the letter from Abbey is dated 30 Nov and the letter CapQuest refer to that Abbey sent says 27 Nov.
How should I deal with them? Should I ask them to prove the debt or should I tell them that it is statute barred (if it was owed in the first place as the account was a joint one and clearly it was not sorted by my ex lol). Or should I just ignore it - are they likely to try to summons me to court now, or will they try and send in baillifs?

I had the same thing, I'm just going to ignore it for now and see what their next move is as it seems quite a few people have had these. It seems CapQuest has done a bulk buy (lol) and they just casting a net to see what they catch!0

If you have not made a payment towards this debt or acknowledged it in writing in the past 6 years then it is probably statute barred.
Was it possibly a joint debt that someone elses has been making payments towards? If it was then i would definately be requesting proof - if not, then it is statute barred and unenforable in court. They can ask you to pay but that's all they can do. If my memory serves me right, this may be an OD which has not changed in size in the last 18 years. It was a joint account, but there is no way on Earth that my ex will have made any payments towards it! I wonder if he has now also had the same letter!0

No, they cannot record this or blemish your credit record with it. If it was ever on there, it would now be gone and can't be recorded again. My husband received a letter from Telogram about 4 weeks ago , we ignored it and then got a letter from Capquest about an old Abbey account - approx 15 years old - Thanks to all the help and advice on here he sent Statue Barred Letter by recorded delivery with an electronic signature and despite previous veiled threats re "May" investigate further "May" call at your property to confirm identity wtc, we then received a letter confirming account closed and no further action would be taken. There was nothing on our credit report - it was never added and as previous poster said it is now legally too late for them to do so. Hope this helps. But please use an electronic signature or get someone else to sign the letter so they can't try and fake a signature (not that I'm paranoid or anything just don't trust CRAPQUEST lol!.

Thanks for the replies - I am not worried as I am now absolutely confident that they cannot do anything. I expected them to call me back yesterday and they didn't nor did they today. I have printed off the prove it letter and if they respond do that with evidence, will send them the statute barred letter as I am only vaguely recalling an account with Abbey - I can't remember if the account was closed or paid off. I would have expected to have received something from them in respect of any debt at the time, but I never did!!!!0

I had the same thing a few weeks ago, they seem to have bought a lot of old Abbey debts. My letter was in a name I haven't used for 17 years :rolleyes: I sent the 'statute barred' letter, recorded delivery, and within 7 days had confirmation that the account had been closed and no futher action would be taken
