So is this all the OR would want? Or do they look at your bank statement each month? And if i have worked overtime and have made say £200 more do I have to give them half?0
-
this goes into the bankruptcy forms you submit to the courts. after the court bit you will need to have an interview with the official receiver. the receiver will also ask for the last 12 months bank/credit card statements and the last 3 months payslips. in the interview you will go through the soa with the receiver and the reasons for debt etc you would need to tell the receiver that your salary varies and see what they say, you wouldn't automatically have to pay them half, it would depend how much surplus this left you with0

Thanks confused, but what if one month i dont use my car and save and extra £160... is that for me to keep? am I meant to tell every one?0
-
that would be ok. it's more if you have a difference on your pay
these are guidelines. if you have £100 for petrol but spend £80 on petrol one month and £20 more on food that's not an issue0 -
But if i don't spend an extra £20 will they know? Am i meant to declare it?
Sorry for all the q's.. but thank youevery one for your help.0 -

What you do with your money after you have been made bankrupt is your business. The OR is not interested unless you stash away 1000's in savings.0 -
After all reasonable (not basic) living expenses have been taken then if you have a surplus of over £99, a percentage (from 50-70%) is taken from this.
.
So this only applies if my SoA shows that I have more than £99 left over after every thing... then they might ask to have money from me each month... but if for instance one month I don't use my car and eat ay my Girl/f's house and have £200 left over... its mine to do what i want with?0 -
yes, basically they give you reasonable allowances based on your normal outgoings. If you choose not to eat for a month you can use the money however you want. They dont grab any excess money left out of the bank each monthHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
