My credit is shocking (Even worse after this eposide) but I do genuinely want to clear my debt and would rather do it without defaulting (Seeing as I did spend it) It's just the interst rate which is hard. I pay £97 a month and £88 is going straight on Interest. Anyway to be honest the Aqua debt is more worrying for me at the moment.2010 is the year I'm going to sort my life out! :j

Well I cannot assure you I am not a bored debt collector, I'm a skint recruitment consultant and I see nothing in my post that would suggest this. I saw a post about using the word legal and I just used that word, Nothing more nothing less. I have only posted to get some advice on how to deal with a collection agency as I don't know who to turn to at the moment. That's all I'm not after anything else.

Fair enough. Follow the advice above, send a CCA request by recorded delivery ( template available here http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=getting_a_copy_of_your_credit_agreement_and_account_details )
send the Statutory Fee of £1 as a Postal Order
and dont speak to them on the phone, ever.

I'm just a bit unknown when it comes to debts as even though I have a fair few I normally pay. With the exception of the Aqua card as it was over 35% interested.
So to clairfy who do I send the CCA thing to? To the Debt agency? and should I wait until they write to me and then respond with one of the templates as above?

Thank you I really don't know where to even start. I have paid loads of bank charges (For accounts which are now closed) and loads of Credit card charges.
Currently I owe
£4400 Barclaycard 29(ish%) Apr
£2187 Aqua (Well debt collection agency now)
£2800 on a loan to Barclays which I pay £261 a month so have about 11 months to go on.
£200 Capital one
£870 Overdraft with barlclays and cos I am in a pickle I go into what Barclays call a 'Reserve' of £150 each month about 2 weeks after payday Which normally incurs about £70 charges a month for me aswell.2010 is the year I'm going to sort my life out! :j

Send the CCa to the debt agency. Whether you wait for the letter or send it now does not really matter.
However, it is just possible that 1st credit are chasing someone esle for another debt (not unusual) so it may pay to wait until you are sure what is going on.

Well Aqua had my home number as well and there have been no calls on that only my Mobile..There has only been about 5 calls so far. So I think I'm going to wait until I get a letter. I really appreciate all your help.2010 is the year I'm going to sort my life out! :j

This may sound strange but since you cannot currently be charged interest on the Aqua debt, and you can stop 1st Credit calling you, for the time being it may be better to concentrate on the other debts.
The Barclays "buffer zone" looks incredibly expensive - I would go for that first (but maintain payments on the other debts).
The template letter is good but between
"Please treat this also as a formal complaint under the procedures set out by the Financial Ombudsman (FOS). As such, you are required to send me a copy of your company complaints procedure."
And
"Furthermore, please note that the FOS consider it 'unfair' for you to continue with phone calls when requested not to do so."
put
"You are also required to investigate my complaint and provide me with a final response within eight weeks from the day on which you receive it. That response must include any proposals you deem appropriate to resolve the matter and tell me that how long I have to take my complaint to the Financial Ombudsman Service. You must also enclose a booklet published by the Financial Ombudsman Service with your response."
Note that if you are sent a letter by recorded delivery a digital version of the signature will be available on line a couple of days later and can be copied and pasted by an unscrupulous person.
So a DCA will then be able to "prove" there is a debt owed by a Mr M Mouse!0
