    In which case, why was auntie stupid enough to lend him the money in the first place?
    She should have done her own credit check!
  • Legally it was a social arrangement therefore the courts would presume that there was no intention to create contractual relations (and therefore it would be up to the aunt to prove that it was) and without a written contract that would be very difficult to do.

    I'd repay her to the balance, maybe continue 1 month (£80 or so) to say thanks for helping out and draw a line under it. Going through court she wouldn't get anything else!

    If he really has paid the debt off in 6 months then he probably owes about £52 - £28 balance plus £24 in interest.
    It's fair enough to say thanks for helping out, but if she really is demanding £1000 then I'm not sure I'd be wanting to say thanks for anything. I'd pay up the £52 (up to £73 if she can show it's cost her that much in interest) but nothing more.

    How dare you assume that my brother is a chav, he made a stupid mistake when he drink drove, believe me he regrets it. Just because he's unemployed this doesn't mean he's a chav, yeah he's not the most perfect lad but he's kind hearted and whilst I don't know the full story behind all this, I only have my brothers word for it.     The interest if he has stuck to his agrrement ie forty pounds a fortnight should be tops thirty pounds so he could just pay an extra payment.

    You posted FAR too much information for people to notcomment on it....you didnt need to mention the offence , or the running away from the punishment....

    No apologies this end....drink drivers -= scum of the earth , not far behind child molestors and sex offenders in my eyes

    This thread should be in discussion time in my opinion , you cant seriously expect the average poster to not get riled by such a scum filled tale

    And jimmy , i hate drink drivers for a VERY good reason , especially ones who duck the punishment
