In the interest of learning.. what are CCJ's

I've heard a lot about CCJ's but don't actually know what they are or why people get them. I've fathomed that they're given to people who cant or don't pay but i'm flumoxed as to why some people get made bankrupt when they don't/can't pay and others get CCJ's

Also, I havn't got any CCJ's or any sniff of getting anywhere near one when I went BR, as oon as we knew we were insolvent we had to get help with the BR order.. is that wrong? Should I have waited till we got to the CCJ stage?

Apologies if I have offended anyone with my questioning. That really isn't my intention, I just want to know how it all works really.

    A CCJ is a county court judgement. When yu cannot or willnot pay a debt the creditor can go to court to get one, it is a way of enforcing a debt. The reason that the creditors like them is that in the eyes of the court this proves that you owe the debt. The court then put you in a repayment plan. The CCJ is a stepping stone. For instance once they prove you owe the debt if you dont pay they can ask the court to appoint a baliff or they can then get a charge against your property. Most creditors although they threaten bankruptcy would rather go the CCJ route as there is more chance of them getting paid.

    There was no need to wait for CCJ's in your case, i presume there was little chance of your circumstances changing in the near future so you were at th insolvent stage already

    I'm glad you asked that question as I wanted to know as I've just received one from one of the creditors via a solicitor today; I am hoping to pay Court fees for Bankruptcy on the 15th and I don't know how the CCJ will affect the Bankruptcy. I'm registered with CCCS and they have been great .. wish I'd rang them a long long time ago but at the moment, haven't been able to get someone on the phone to ask. I have a feeling they are snowed under at the mo (pardon the pun and apologies for jumping into your thread)

    Do you mean you have just have the actual judgement through, or just the initial papers/claim form?

    The thing is I've received the CCJ (acceptance) and how much I have to pay by instalments (first one has to reach them by 26 Dec).

    The actual judgement and instalment amount I have to pay; I was going to pay the Court fees for Bankruptcy on 15 Dec and don't know how long it all takes to process and how the CCJ will affect the Bankruptcy ?

    When you go bankrupt one of the first things the OR asks is if you any legal procedures outstanding, just tell them and they will send letter to the court to cancel the payments

    The CCJ won't effect the BR, but the BR will certainly effect the CCJ.

    You won't have to concern yourself about paying it. :);)

    My concern here is how much time it takes to BR after payin the fees plus if I don't pay any instalments, the Bailiffs can come rollin in ?!
