Remortgage problem

Hi,
Have a problem regarding the survey for a remortgage.
The lady doing the survey has pointed out there may be some movement of the house as some bricks were loose under the bathroom window. as a result we had to get a NHBC builder to take a look and make a report before we could go any further.
We have had 2 NHBC builders to take a look at the problem. Both said the same thing. There is no movement, the loose bricks are caused when the bathroom (110 year old terrace) was moved into the house and they divided the bedroom to make a bathroom. The mortar has come loose around the soil stack entrance into the house. nothing to worry about.
However,
Both builders dont want to put this in writing as they think that if anything happens to the house they would be liable for giving advice or something.
are there fears justified?
PS only an NHBC builder could give me a report. They wont accept FMB or anything else
